ORDER : 1. We have heard learned counsel for the respondent-State of Chhattisgarh. 2. On 30.05.2024, we had passed the following order: “This court on 10.02.2022 has directed the respondent-State of Chhattisgarh to place the matter before appropriate authority for grant of remission in terms of the State Rules keeping in view the requirement of Section 433-A of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) and the matter was certainly placed before the appropriate authority. Vide letter dated 20.04.2022 the Jail Superintendent, Central Jail, Raipur, Chhattisgarh has informed this court that at the relevant point of time when the matter was placed for grant of remission before the Competent Authority, the appellant has not completed 20 years of imprisonment, including remission. Today, learned counsel for the respondent-State of Chhattisgarh has informed this court that the appellant as on date certainly completed 16 years of actual sentence and along with remission he has completed more than 20 years and the Jail Authority shall certainly forward this matter to the State Authorities for grant of remission in terms of the State Rules. Let the same be done positively within a period of four weeks. List the matter after summer vacation, 2024.” 3. Pursuant thereto, Ms. Pratibha Pandey, Additional Superintendent of Police, District Mahasamund, Chhattisgarh has filed status report dated 14.11.2024. 4. As per the status report, a report was called for and received from the Superintendent of Jail, Central Jail, Raipur. 5. As per the Jail Report dated 30.05.2024, appellant-Kamdev was released from Central Jail, Raipur, Chhattisgarh pursuant to Order dated F-4-83/3-Jail/2023, Nawa Raipur dated 14.06.2023 passed by the Home Department, Government of Chhattisgarh under Section 432 of the Code of Criminal Procedure, 1973. 6. It is stated that as per the Jail Report, appellant had undergone more than 20 years 03 months and 20 days in custody. 7. Be that as it may, since the appellant has already been released vide order 14.06.2023 in terms of the remission policy of the State, nothing further survives in this appeal. 8. The appeal is, accordingly, disposed of. 9. Pending applications, if any, stand disposed of.
