ORDER : 1. No one appears to argue the matter on behalf of the respondent. Efforts for mediation have failed. 2. The petitioner-wife seeks transfer of proceedings of the Case No. 843 of 2024 titled “Ankit Kumar Srivastava Vs. Shiwani Sinha” filed under Section 13 of Hindu Marriage Act,1955 by the respondent-husband pending before the Principal Family Judge, Family Court, Lucknow, Uttar Pradesh to the Court of Principal Judge, Family Court, Palamu, Jharkhand. 3. On a perusal of the transfer petition preferred by the petitioner, it is apparent that both petitioner-wife and the respondent-husband were working in a reputed tech Company ‘IBM’ at Bangalore. The marriage seems to be the result of mutual affinity between the two which developed at the workplace. The petitioner-wife went to the matrimonial home after the marriage which was solemnized on 19th January, 2023. The petitioner and the respondent lastly resided together at Kanpur. The petitioner-wife has categorically admitted in the transfer petition that she deserted her husband on 27th January, 2024. The petitioner came to know of the proceedings of the divorce petition on receiving the summons forwarded by the Family Court, Lucknow, whereafter she herself lodged a complaint against the respondent-husband alleging harassment on account of demand of dowry, etc. 4. From the above facts, it is apparent that it is the petitioner-wife who has abandoned her husband. The fact that it was a love marriage between the parties and the complaint on account of demand of dowry etc. came to be filed by the petitioner only after receiving the notice of the Divorce Petition, convinces us that the petitioner-wife does not have a bona fide ground for transfer of the divorce petition filed by the respondent-husband. The petitioner-wife is herself a well-qualified lady and she can contest the proceedings of the divorce petition by the virtual mode, if so desired. 5. In view of the above discussion, the transfer petition fails and is dismissed as being devoid of merit. However, the petitioner-wife is given liberty to participate in the proceedings of the divorce petition by virtual mode, if such facility is available in Lucknow, unless otherwise directed. 6. Pending application(s), if any, shall stand disposed of.
