ORDER : 1. Heard Mr. Abhishek Gupta, learned counsel for the petitioner and Mr. Amogh Bansal, learned counsel for the respondent-State. 2. The petitioner is accused of offences punishable under Sections 419, 420, 408, 409, 467, 468, 471, 477, 477A, 201, 109 read with Sections 34, 120B of the Indian Penal Code, 1860, Section 3, 4, 5 read with Section 6 of the Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992 and Section 66D of the Information and Technology Act, 2000. 3. Mr. Abhishek Gupta, learned counsel for the petitioner submits that the petitioner has been in custody since 18.04.2024. He also draws attention to the counter affidavit, wherein it has been averred that as of now there are 103 accused persons and the investigation is pending with regard to further 83 other persons. According to learned counsel, the charges have not yet been framed and considering the large number of witnesses and documentary evidence the trial is likely to take some time to conclude. 4. Mr. Amogh Bansal, learned counsel for the State has vehemently opposed the prayer and submit that the petitioner has been charged with impersonation and the FSL Report clearly implicates him inasmuch as the handwriting on the answer-sheets and of the petitioner has tallied. 5. Considering the facts and circumstances and the period undergone and the length of time of the trial will take, we are inclined to enlarge the petitioner on bail. 6. Let the petitioner be enlarged on bail subject to the satisfaction of the Trial Court on such conditions as the Trial Court may deem it fit to impose. We also direct that the petitioner may be directed to surrender his passport if he is in possession of one. 7. Mr. Abhishek Gupta, learned counsel for the petitioner also undertakes that the petitioner will not delay the trial from his side. 8. The Special Leave Petition is disposed of in the above terms. 9. All pending applications, if any, also stand disposed of.
