ORDER : We have heard learned counsel for the petitioner as well as learned counsel for the respondent no.1. 2. Learned counsel for the petitioner has drawn the attention of the Court to Order dated 20-04-2023 passed by the High Court of Judicature at Bombay, at Nagpur in Writ Petition No. 7311 of 2022 preferred by the respondents herein. 3. This Court in SLP (C) No. 10207/2023 issued notice vide order dated 15.05.2023 and passed an interim order staying the effect and operation of the aforesaid order dated 20.04.2023. Finally, the said Special Leave Petition was disposed of by this Court vide Order dated 18.03.2025 by granting leave and requesting the High Court to take up the Writ Petition No. 7311/2022 for hearing expeditiously. It was further directed that interim order passed by this Court on 15.05.2023 shall continue to operate till the writ petition is decided. 4. That writ petition is still pending before the High Court. 5. In the light of the above, we find the impugned order dated 05.05.2025 passed by the High Court, particularly paragraph 4 thereof, contrary to the aforesaid Order of this Court. Paragraph 4 of the impugned order reads thus:- “4. In our considered opinion since the petitioner would have a right, to seek continuation of the lease, for a further term, or continuation of the allotment, the petitioner therefore, will be entitled to continue the possession during the pendency of the petition, on account of which we direct respondent No. 1 who is claimed to have put a seal on the block No. 5 to remove the same and deliver the possession of same to the petitioner within a period of one week from today.” 6. After hearing the matter for sometime, we are of the view that the High Court may hear and decide Writ Petition No. 7311/2022 expeditiously as was already directed by this Court in the earlier round of litigations but paragraph 4 as extracted above is unwarranted. 7. Accordingly, paragraph 4 of the impugned order dated 05.05.2025 is hereby set aside. 8. We make it clear that we have not expressed any opinion on the merits of the Writ Petition and all contentions available for the parties are kept open. 9. With the aforesaid, the Special Leave Petition is allowed to the extent indicated above. 10. Pending application(s), if any, stands disposed of.
