ORDER : 1. Application for listing review petitions in open Court is allowed. 2. Delay condoned. 3. The present petitions have been filed seeking to review the order passed by us, confirming the order of the Single Judge Bench of the High Court, allowing for the re-determination of compensation with respect to land acquisition proceedings which commenced in 2022. 4. Learned senior counsel appearing for the petitioner vehemently contended that material facts pertaining to a 1962 acquisition of the same property have not been placed before the High Court, or before this Court on the earlier occasion. 5. We are not inclined to go into the said issue in these proceedings, as the petitioner has already filed a comprehensive suit in CS No.526/2020, on the file of Additional Civil Judge, Senior Division, Guruharsahai. 6. Mr. P.S. Patwalia, learned senior counsel appearing for the respondent(s) submitted that the amount as per adhoc award has already been withdrawn. Be that as it may. Inasmuch as there is a comprehensive civil suit pending, we only request the Additional Civil Judge, Senior Division, Guruharsahai to dispose it of within a period of one year. 7. We make it clear that the Civil Court is expected to go into the issues raised independently, notwithstanding the earlier orders passed either by the High Court or by this Court, as what is to be decided in the civil suit is the effect of the decree, which obviously was rendered without considering the material which is sought to be placed before the Court now. 8. We make it clear that the issues before the Court will have to be decided on their own merits. We further observed that in the event of any factual finding by the Trial Court on the existence of the prior award, obviously, the effect of the earlier decision either by the Reference Court or by the High Court as confirmed by this Court will not have no bearing. 9. Needless to state that if the Trial Court comes to the conclusion that there was indeed no earlier award as against the respondents or their predecessor, then the judgment rendered earlier inter se parties would be enforced. 10. The review petitions stand disposed of accordingly. 11. Pending application(s), if any, shall stand disposed of.
