ORDER : 1. Heard Ms. Ganivada S.P.Durga Gayatri, learned counsel representing Sri Talluri Krishna Sankya, learned counsel appearing on behalf of the petitioner on record, learned Assistant Government Pleader for Services-I appearing on behalf of the respondent Nos.1 & 2 and Sri T.Sharath, learned standing counsel for respondent No.3 2. The petitioner approached the Court seeking amended prayer as under: “…to issue a writ order or direction more particularly one in the nature of a writ of mandamus directing the Respondent Nos. 2 to 6 to allow the Petitioner to complete the remaining 161 days of the internship period by exempting the official notification of amendments to regulations issued by the Respondent No 4/Dental Council of India (DCI) vide No. DE-87(1)-2015 by considering the no objection letter cum internship extension letter dated 30.09.2025 issued by Respondent No.6 to the Petitioner and also by considering the petitioners pregnancy complications health issues and other unforeseen circumstances such as Covid-19 pandemic and the petitioners firstborn child's health complications in the interest of justice and pass….” 3. The case of the petitioner in brief as per the averments made by the petitioner in the affidavit filed by the petitioner in support of the present Writ Petition is as under:- It is specific case of the petitioner that the petitioner was admitted to the Bachelor of Dental Surgery (BDS) course in 2016, graduated in 2021, and obtained a Provisional Certificate from Respondent No. 6’s college, affiliated with Respondent No. 3 University. Owing to marriage, two pregnancies complicated by Gestational Diabetes Mellitus, Subclinical Hypothyroidism, and Bronchial Asthma, as well as the COVID-19 pandemic, the petitioner had to temporarily discontinue the mandatory one- year paid internship. After resuming, the petitioner completed about 6–7 months of mandatory paid internship but again paused in 2024 when the petitioner’s firstborn child was diagnosed with ADHD and Autism, leaving 161 days incomplete. Subsequently, Respondent No. 6, in its letter dated 30.09.2025 addressed to the petitioner herein, enclosed its opinion to provide no-objection and recommended permission for the petitioner to complete the remaining 161 days of the mandatory one year paid internship despite the expiry of the 9-year limit prescribed by the Dental Council of India (DCI).
Subsequently, Respondent No. 6, in its letter dated 30.09.2025 addressed to the petitioner herein, enclosed its opinion to provide no-objection and recommended permission for the petitioner to complete the remaining 161 days of the mandatory one year paid internship despite the expiry of the 9-year limit prescribed by the Dental Council of India (DCI). As the Respondents were unlikely to grant such extension, the petitioner filed the present Writ Petition seeking a direction to permit completion of the pending mandatory paid internship by exempting the official notification of amendments to the regulation issued by Respondent No. 4 vide No. DE-87(1)-2015. 4. PERUSED THE RECORD. A. Letter, dated 30.09.2025 issued by the 6 th respondent Institution in favour of the petitioner is extracted hereunder:- With reference to subject cited above and directions of DME & Principal. GDC&H. Afzalgunj, we have no objection in Syeda Nayeem Khatija Razvi continuing her internship program in our institute as per the status (161days One Hundred and sixty-one days) enclosed in the Principal GDC&H letter. Postings for the same are mentioned below and it is being informed to the student that she is required to complete the program with in the prescribed duration of 9 years from the date of admission as per the Dental Council Of India Revised BDS Course (7th amendment) Regulations. 2015. The petitioner in the present writ petition seeks a direction to the respondent Nos.2 to 6 to allow the petitioner to complete the remaining 161 days of the mandatory paid internship period by exempting the official notification of amendments to regulations issued by the respondent No.4/ Dental Council of India vide No.DE-87(1)-2015 duly considering the No Objection letter cum internship extension letter, dated 30.09.2025 issued by the respondent No.6 herein in favour of the petitioner, duly considering petitioner’s pregnancy complications, health issues and other unforeseen circumstances such as COVID-19 pandemic and the petitioner’s firstborn child’s health complications. 6.

Learned Assistant Government Pleader for Services-I appearing on behalf of the respondent Nos.1 & 2 and learned standing counsel appearing on behalf of the respondent No.3 brings to the notice of this Court that the petitioner has not put-forth petitioner’s grievance as put-forth in the present writ petition to the respondent No.2 as on date, and hence, petitioner cannot complain inaction on the part of the respondents herein and seek issuance of a mandamus. The learned counsel appearing on behalf of the respondents however contends that in view of the fact that No Objection letter cum internship extension letter, dated 30.09.2025 had been issued in favour of the petitioner by the 6 th respondent, the petitioner may be directed to put-forth the petitioner’s grievance as put-forth in the present Writ Petition before the 2 nd respondent and the 2 nd respondent would duly consider the same in accordance to law, within a reasonable period. 7. Learned counsel appearing on behalf of the petitioner does not dispute the said submission made by the learned counsel appearing on behalf of the respondent Nos. 2 & 3. 8. Taking into consideration:- a) The aforesaid facts and circumstances of the case. b) The submissions made by the learned counsel appearing on behalf of the petitioner, learned Assistant Government Pleader for Services-I appearing on behalf of the respondent Nos.1 & 2 and the learned standing counsel appearing on behalf of the respondent No.3. c) The contents of the letter, dated 30.09.2025 issued by the 6 th respondent in favour of the petitioner (referred to and extracted above) which clearly indicates No Objection letter cum internship extension letter issued in favour of the petitioner permitting the petitioner to continue petitioner’s mandatory paid internship program in the 6 th respondent institute as per the status (161 days) enclosed in the Principal GDC&G letter. d) The fact that the petitioner did not put-forth petitioner’s grievance to the 2 nd respondent herein pertaining to permitting the petitioner to continue petitioner’s mandatory paid internship duly considering the No Objection letter cum internship extension letter, dated 30.09.2025 issued to the petitioner by the 6 th respondent herein.
d) The fact that the petitioner did not put-forth petitioner’s grievance to the 2 nd respondent herein pertaining to permitting the petitioner to continue petitioner’s mandatory paid internship duly considering the No Objection letter cum internship extension letter, dated 30.09.2025 issued to the petitioner by the 6 th respondent herein. The Writ Petition is disposed of, the petitioner is directed to put-forth the petitioner’s grievance as put- forth in the present writ petition to the 2 nd respondent herein pertaining to allowing the petitioner to complete the remaining 161 days of the mandatory paid internship period by exempting the official notification of amendments to regulations, issued by the respondent No.4/Dental Council of India (DCI), vide No.DE-87(1)-2015 by considering the no objection letter cum internship extension letter, dated 30.09.2025 issued in favour of the petitioner by the respondent No.6 herein, within a period of one (01) week from the date of receipt of copy of the order and upon the petitioner submitting the said representation to the 2 nd respondent herein, who is the competent Authority, the 2 nd respondent is directed to consider the request of the petitioner, in accordance to law, duly taking into consideration the no objection letter cum internship extension letter, dated 30.09.2025 issued by the respondent No.6 herein in favour of the petitioner herein and pass appropriate orders, within a period of one(01) weeks thereafter on receipt of the said representation from the petitioner pertaining to the request of the petitioner, to allow the petitioner to complete remaining 161 days of the mandatory paid internship period and duly communicate the decision on the said subject issue to the petitioner. However, there shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
