JUDGMENT : 1. The writ petition is filed seeking police protection for the life of the 2 nd petitioner for carrying out the administration of Pallikkara Juma Masjid and Wakf property in terms of Ext.P1 civil court decree. 2. An interim order was passed on 4 th February 2022, which reads as follows: “Heard the learned counsel appearing on either side as well as the learned Government Pleader. There will be an interim direction that the 2 nd petitioners in both the writ petitions shall carry out the management of the 1st petitioner Muslim Jama-ath jointly and without creating any law and order issues. In case there are any law and order issues or obstructions, the 2 nd respondent shall provide adequate protection for the peaceful conduct of the affairs of the Pallikkara Muslim Jama-ath. In view of the fact that, it appears that there is a chance that the issue can be resolved amicably through mediation, the private parties in both the writ petitions are directed to appear before this Court on 10.2.2022.” 3. Thereafter, on 09.03.2022, this Court passed another order as follows; “Learned Senior Counsel appearing for respondents 10 and 12 in WP (C) No. 3539 of 2022 submits that the suits in respect of the property are pending before the Waqf Tribunal. It is clarified that the interim orders issued in this matter will not stand in the way of the consideration of the suits or any interim applications filed there under, on merits, untrammelled by anything stated in the interim order.” 4. In view of the fact that the suits are pending with respect to the property before the Wakf Tribunal, it will be open to the petitioners or the party respondents to approach the Wakf Tribunal for appropriate reliefs. However, it is made clear that in case there is any threat to the life of the 2 nd petitioner, he can approach the 2 nd respondent, who will take appropriate action in accordance with law. 5. The writ petition is disposed of as above.
