ORDER : RAJESH SHANKAR, J. 1. Since similar issues have been raised in all the writ petitions, the same are being tagged and taken up together with the consent of learned counsel for the parties. 2. These writ petitions have been filed for quashing the notices issued to the petitioners to vacate their shops situated at Govindpur Haat, Lal Bazar pertaining to Khata No.202, Plot No.1948 of Mouza Govindpur within the specified period. Further prayer has been made for issuance of direction upon the respondent no.2 not to dispossess the petitioners from their respective shops situated at the said market. The petitioners have also prayed for issuance of direction upon the respondent no.2 to forthwith refund the amount deposited by them towards rent with respect to their respective shops till March, 2024, as according to them, the respondent no.2 does not have the ownership of the concerned land over which the shops are situated. 3. Learned counsel for the petitioners submits that in addition to the other issues raised in the present batch of writ petitions, the respondent no.2 cannot evict the petitioners from the shops in question without following due procedure provided under law. Hence, the impugned notices issued to the petitioners directing them to vacate the shops in question are illegal and without jurisdiction. 4. Notice. 5. Mr. Gaurav Abhishek, learned A.C. to A.G. appears and waives notice on behalf of the respondent no.1 in all the writ petitions. 6. Mr. Arvind Kumar, Advocate appears and waives notice on behalf of the respondent no.2 in all the writ petitions. 7. Learned counsel for the petitioners is directed to serve two copies of all the writ petitions along with annexures to the learned counsel for the respondent no.2 by 24 th January, 2025. 8. Learned counsel for the respondent no.2 appearing in all these cases prays for and is allowed four weeks’ time to seek instruction and file respective counter affidavits. 9. Put up these cases under the same heading on 25 th February, 2025. 10. In the meantime, the petitioners shall not be evicted by the respondent no.2 from their respective shops.
