JUDGMENT : Tarlok Singh Chauhan, CJ. I.A. No.10470 of 2025 1. The intervention application is totally misconceived and it is dismissed accordingly. In case the petitioner has any grievance, he is at liberty to avail of such remedy as available to him under the law. W.P. (PIL) No. 2375 of 2024 2. The instant Public Interest Litigation has been filed for grant of following substantial reliefs:- (a) For issuance of an appropriate writ(s)/order(s) /direction(s) commanding upon the respondents to take immediate and urgent steps towards creation and sanction of the 1033 posts of teachers in 19 subjects across 510 10+2 Government Schools in the State of Jharkhand, as recommended by the School Education and Literacy Department after due deliberations and consultations. (b) For issuance of an appropriate writ(s)/order(s)/direction(s) commanding upon the respondents to take immediate and urgent steps towards appointment of teachers for the 1033 Posts of teachers in 10+2 Government Schools as there has no appointment of teachers in the said subjects since the reorganization of the State i.e. for more than 2 decades. (c) For issuance of an appropriate writ(s)/order(s)/direction(s) commanding upon the respondents to provide for appropriate age relaxation of at least 5 years in each category of students in any appointment process towards the appointment of trained teachers in the various subjects for 10+2 Government Schools, as there has been no appointment done for more than a decade, thereby adversely and arbitrarily affecting the aspiring and trained candidates interested in teaching posts. 3. On 22.07.2025, the Court passed the following orders:- “1. In pursuant to the order dated 16.04.2025, an affidavit has been filed on behalf of State. 2. It has been stated that the process of appointment has begun. Applications have been invited. The last date of submission is 27th July 2025. It has been stated that examination is to be conducted by the Jharkhand Staff Selection Commission (JSSC). It has further been stated that after completion of the recruitment process, students will be called for counselling. It has also been stated that the on-going process would require a minimum 9 months for completion of the same. 3. This Court has posed a question to the learned counsel for the State that on what basis the time frame of nine months, as shown in paragraph no.14 of the said affidavit, is required for completion of the process. 4. It is contended by Mr. 3. It is contended by Mr. Ashutosh Anand, learned A.A.G- III that on the basis of instruction received from the Department, such statement has been made. 5. Since the recruitment agency is the JSSC and also in view of the order dated 16.04.2025 passed by the Co-ordinate Bench of this Court, wherein, a command has been issued upon the JSSC to conclude the process within 3 months from the date of passing of the said order, this Court deems it proper to implead the JSSC through its Secretary as party to the proceedings. 6. Let necessary addition be made in the array of the respondents during course of the day. 7. Let the copy of the petition be served upon Mr. Sanjoy Piprawall, who has informed to appear on behalf of the newly added respondent-JSSC by tomorrow. Let the name of Mr. Sanjoy Piprawall appear in the daily cause list, henceforth as counsel for the respondent-JSSC. 8. The newly added respondent–JSSC is directed to file an affidavit by showing the time frame under which the process of recruitment will be completed. 9. Let the instant writ petition be listed on 07.08.2025.” 4. In compliance to the aforesaid orders, the Deputy Secretary, Jharkhand Staff Selection Commission has filed an affidavit of compliance and it shall be apt to reproduce paragraph 4 to 8 thereof, which reads as under:- “4. That it is stated that Department of Personnel, Administrative Reforms and Rajbhasha, Government of Jharkhand vide letter No.3236 (Anu) dated 02.06.2025 forwarded the requisition of the School Education and Literacy Department (Secondary Education Directorate) Govt. of Jharkhand to the J.S.S.C for starting the selection process for Appointment on the post of Madhyamik Acharya in the secondary Schools of the state of Jharkhand for different subjects and categories. 5. of Jharkhand to the J.S.S.C for starting the selection process for Appointment on the post of Madhyamik Acharya in the secondary Schools of the state of Jharkhand for different subjects and categories. 5. That it is stated that it is stated that JSSC after receiving the aforesaid requisition on 04.06.2025 started selection process for appointment of Madhyamik Acharya in the state of Jharkhand accordingly Advertisement No.02/2025 i.e. Jharkhand Parikshit Madhyamik Acharya Sanyukt Pratiyogita Pariksha, 2025 was published by the J.S.S.C. on 10.06.2025 by which, applications were invited from the eligible candidates for considering their candidature for appointment on the post of Madhyamik Acharya against different subjects and categories. 6. That it is stated that JSSC fixed 27.06.2025 as dated of receiving the Online Application form from the candidates. 7. That it is stated that last date for submission of the Online Application form was fixed has 27.07.2025. 8. That it is stated that in compliance of the order dated 22.07.2025 passed by this Hon'ble Court in this case, time line for completing the selection process for appointment on the post of Madhyamik Acharya pursuant to Advertisement No.02/2025 has been prepared which is being filed herewith. 5. The timelines as per the affidavit have been set out in Annexure-A which read as under: - “Jharkhand Trained Madhyamik Acharya Combined Competitive Examination – 2025 Advertisement No. 02 of 2025 Name of the Post-Madhyamik Acharya Total Post-1373 S. No. Stage of Progress Timeline (Date) 1 Last date for editing of Online Application Forms by the candidates, 04.08.2025 2 Last date fixed for receiving Offline Application Forms from the candidates/ petitioners in compliance of the Orders passed by this Hon'ble Court in W.P.(S) No 3786/2025, W.P(S) No.-3810/2025, W.P(5) No 3657/2025. 14.08.2025 3 Selection of the Agency for conducting the CBT based examination 18.08.2025 4 Issue of Work order and Agreement with the Agency 21.08.2025 5 Issuance of the Admit Card to the candidates for their appearance in the Examination (same will be uploaded on the website of the JSSC and information about the same will be also given to the candidates) 02.10.2025 6 CBT based examination to be conducted. 11.10.2025 to 18.10.2025 7 Publication of the tentative Answer key and Submission of objections by the candidates 03.11.2025 to 07.11.2025 8 Publication of Final Answer Key after correction of the Model answer on the basis of the report of the Expert/Expert Committee. 16.11.2025 to 20.11.2025 9 Preparation of Combined Merit of all subjects. 15.12.2025 10 Publication of list of shortlisted candidates for verification of the documents/ testimonials. 20.12.2025 11 Document verification of the shortlisted candidates (approx. 1600 candidates will be shortlisted) 29.12.2025 to 04.01.2026 12 Last chance for appearance of those candidates who were absent on the earlier fixed dates for verification of their testimonials/documents 10.01.2026 13 Publication of the final result after verification of the testimonials etc. 25.01.2026 14 Sending recommendation for appointment of the candidates to the Department. 30.01.2026 6. Now that the respondents have set the timelines for filling up for the posts of Madhyamik Acharyas, the instant petition has been rendered infructuous and is disposed of accordingly. 7. Since 30 th of January 2026 has been fixed for sending recommendation for appointment of the candidates to the Department, we deem it appropriate to list this matter for compliance in the month of March 2026. 8. Accordingly, this writ petition is disposed of. 9. All pending Interlocutory Applications shall stand closed.
