ORDER : VIBHU BAKHRU, CJ. 1. The complainants have filed the present complaint alleging willful disobedience of the order dated 13.09.2023 passed in the respective writ petitions preferred by them (Writ petition No.11822/2019; W.P.No.15977/2023; W.P.No.17209/2023; W.P.No.17319/2023; W.P.No.18578/2023 and W.P.No.18947/2023). 2. In terms of the said order, the petitions were allowed and it was found that the complainants were entitled for grant of additional annual increments which were accrued to them on the date after they retired from service, but which were not given to them. 3. Previously, the learned counsel for the accused had filed an affidavit of compliance as well as additional affidavit of compliance. The additional affidavit of compliance setting out the order dated 21.10.2025, was taken note of by this Court in its order dated 21.11.2025. Thereafter, this Court had not accepted the same, in as much as, all consequential benefits arising from the grant of increment had not been extended to the complainants. In view of the above, this Court had observed as under: "5. In terms of the said order, the accused are required to refix the salary of the petitioners by granting them the additional annual increment and also consequentially, refix and pay their pension along with arrears of salary and pension that they have accrued. Once the salary has been refixed, the other necessary consequential benefits would also flow. 6. We do not find any direction in the order dated 13.09.2023 to exclude other consequential benefits that would arise as a consequence of re-fixing of the salary by including an increment." 4. In view of the aforesaid observations, learned counsel for the accused had sought time to take instructions. Learned counsel for the accused has now filed an affidavit of compliance dated 08.12.2025 enclosing therewith an order dated 01.12.2025. A plain reading of the said order indicates that it has been directed that complainants be granted one annual increment in the basic pay that they were drawing as on the date of their retirement with corresponding revision of their basic pension, family pension, retirement gratuity and commutation benefits, which would be determined accordingly. The concerned Pay Drawing Officers have been directed to initiate immediate action for release of the financial benefits in favour of the complainants, on account of the said sanction. 5. In view of the said order dated 01.12.2025, the order, the disobedience of which is complained, has been complied with.

However, the complainants are at liberty to revive the present complaints if actual disbursement does not take place in terms of the order dated 01.12.2025, within a reasonable period.
