ORDER : 1. Heard Sri Vedula Venkata Ramana, learned Senior Designated Counsel representing Sri Ch. Lakshman Kumar, learned counsel appearing on behalf of petitioners and learned Assistant Government Pleader for Education, appearing on behalf of respondent Nos.1 to 4. 2. The petitioners approached the Court seeking prayer as under: “…to issue a Writ of Mandamus or any other appropriate writ declaring that the inaction on the part of respondents 1 to 3 in not rectifying the name of the 2nd petitioner school as Delhi World Public School in terms of the provisional recognition granted by the District Educational Officer, is arbitrary and illegal and direct the respondents to forthwith issue NOC to the 2nd petitioner by duly correcting/rectifying the name of the school as Delhi World Public School instead of Delhi World School so as to enable it to get affiliated to CBSE, New Delhi for the next academic year, taking into account the provisional recognition granted to the school in name of Delhi World Public School (class PP to VIII) in terms of the letter of the 4 th respondent dated 16.04.2024 in proceedings Rc.No.168/A5/2024 and grant...” 3. The case of the petitioners in brief, is that the 1 st petitioner society has established the 2 nd petitioner school for running Classes from Preprimary to VIII. The 2 nd petitioner school was granted a provisional recognition/ETR for the academic year 2024-2025 in the name “Delhi World Public School” as per the proceedings of the District Educational Officer, dated 16.04.2024 wherein the name of the school has been specifically mentioned as “Delhi World Public School” but in the official records of the respondents the name of the school is shown differently as “Delhi World School”. The petitioners have submitted a representation dated 02.12.2025 to the respondent No.3 for issuance of a corrigendum to rectify the school name as “Delhi World Public School” instead of “Delhi World School”. But the respondents have not acted upon the same. Aggrieved by the inaction of the respondents, the petitioners approached this Court by filing the present writ petition. 4. Permission was accorded for classes PP to VII (EM) during the year 2024-25 in the 4 th cited to Delhi World Public School, Manneguda, Abdullapurmet Mandal, Ranga Reddy District The MEO, Abdullapurmet Mandal has recommended to accord provisional recognition for the classes PP to VII (EM) for the academic years 2024-25 to 2033-2034 through the letter 5 th cited. After careful examination of the proposals and recommendation of the Mandal Educational Officer, Abdullapurmet (M) R.R. District and in terms of the orders issued in the references 1st to 3 rd cited, the District Educational Officer, Ranga Reddy District is hereby accorded Provisional Recognition for classes PP to VII (EM) to Delhi World Public School, Manneguda, Abdullapurmet Mandal, Ranga Reddy District for a period of (10) years commencing from the academic years 2024-25 to 2033-34 with instructed to follow the under mentioned instructions scrupulously. 1. That the society shall abide by the instructions/rules and regulations made by the Government or authorized officer time to time. 2. That the Educational Institution shall serve the needs of the locality more particularly. 3. That the institution shall adopt the curriculum and syllabus prescribed by Government from time to time. 4. The school timings, vacations and mid-term holidays shall be prescribed by Government from time to time. 5. That the qualified staff within the age limits prescribed by Government for Government employees shall appointed as per the staff pattern. 6. That the results of the institution shall be satisfactory every year. 7. That the records/accounts shall be furnished to the DEO, every year by the end of academic year at the latest. 5. Structure/fee structure fixed by the Governing Body shall be got approved in the order shall be complied with. 8. That all the conditions prescribed in the GO's and other orders which are not specified in the order shall be complied with. 9. That the school shall not be closed without giving notice both to the parents/ DEO and competent authority. 10. That the list of Governing Body shall be furnished to the DEO every year. 11. That the pay authority at-least six months before. 12. That the school shall not be closed or permitted to be closed only from the date on which summer vacation is declared. 13. That the society shall submit proposal for renewal of provisional recognition immediately in advance i.e., at-least six months prior to the date of expiry of the renewal. 14. That additional sections/higher classes should not be opened without prior renewal. 15. That the recognition is accorded to society and no other society or body can open a school on their behalf. I6. That recognition is accorded to open the school premises in the locality and there shall not be any change to the premises or locality. 17. The society shall provide, the necessary material even if it is costs more than the deposit. 18. Admissions should be made on the basis Record Sheet issued by the Private recognized/ZP/Govt./Aided schools only. TCs/certificates issued by the Secretary, DCEB as Benefited candidates. 19. The Educational Society shall file an affidavit to the affect that there is no deviation or violation of norms/rules by Government from time to time by the end of April every year as per G.O. 3 rd cited. 20. The above ETR is granted subject to conditions that, if it is found later that the school has not fulfilled the pre-requisite conditions under AP Education Act, 1982 reported by State Level inspection Teams and Vigilance Committee, the ETR now beging granted is liable to be withdrawn at-once. 21. 20. That the Educational Society shall follow the Examination schedule as per the time table issued by the DCEB and should conduct DCEB Question papers for Quarterly, Half-yearly, Annual and Pre-final examinations. 22. That the Educational Society should follow school timings as prescribed by Government in school academic calendar. 23. That the Educational Society shall not conduct any events for children which will harm to lives. 24. That the Educational Society shall not conduct classes on public holidays/summer holidays/short term holidays without permission from the undersigned. 25. That the Educational Society should constitute parents teachers committee and should conduct meetings with a committee once in a month. 26. That the Educational Society should not open counters for selling books/badges/stationery etc. 27. That the society/school shall abide by the provisional of Right of Children to Free and Compulsory Education Act, 2009 and the rules thereof. 28. That the school management shall admit in class I, to the extent of 25% of the strength of that class, children belonging to weaker sections and disadvantaged groups in the neighbourhood and provide free and compulsory elementary education t ill its completion. Provided, further that in case of pre primary classes also, its norms shall be followed. 29. That the society/school shall not collect any capitation fee and subject the child or his or her parents or guardians to any screen procedure. 30. That the school management shall not deny admission to any child: (a) for lack of age proof if such admission is sought subsequent to the extended period prescribed for admission. (b) On the ground of religion, caste or race, place of birth or any of them. 31. That the management of school shall ensure. 30. (i) No child admitted be held back in any class or expelled from school till the completion of elementary education in a school; (ii) child shall be subjected to physical punishment or mental harassment; (iii) No child is required to pass any board examination till the completion of elementary education; (iv) Every child completing elementary education shall be awarded a certificate as laid down under Rule 23; (v) Inclusion of students with disabilities/special needs as per provisions of the Act; (vi) The teachers are recruited with minimum qualifications as laid under section 23 (1) of the Act. Provided further that the current teachers who, at the commencement of this Act do not possess minimum qualifications shall acquire such minimum qualifications within a period of 5 years; (vii) The teacher performs his/her duties specified under section 24 (i) of the Act; (viii) The teachers- shall not engage himself in private teaching activities. 32. That the management of school shall enroll students proportionate to the facilities available in the school as prescribed in section 19 of the Act. 33. That the management of school shall maintain the standards and norms of the school as specified in section 19 of the Act. 34. No un-recognized class shall run within the premises of the school or outside in the same name of school. 35. That the school buildings or other structures or the grounds are not used during the day or night for commercial or residential purposes (except for the purpose of residence of any employee of the school) opr for political or non-educational activity of any kind whatsoever. 36. That the school is run by a society registered under the Societies Registration Act, 1860 (21 of 1860), or a public trust constituted under any law for the time being in force; 37. That the school is not run for profit to any individual, group or association of individuals or any other persons; 38. 36. The accounts should be audited and certified by a Chartered Accountant and proper accounts statements of Accounts should be sent to the District Educational Officer every year. 39. The recognition Code Number allotted to your school is 168/A5/2024 . This may please be quoted for any correspondence with this office in future. 40. The school finishes such reports and information as may be required by the by the Samgra Shiksha/District Educational Officer from time to time and complies with such instructions of the State Government/Local Authority as may be issued to secure the continued fulfillment of the condition of recognition or the removal of deficiencies in working if the school. 41. The recognition shall be withdrawn if the contravention of the provisions of the Act. The Rules and conditions of recognition is found and proved. The recognition now granted is liable for withdrawal by the competent authority for violating the rule as prescribed in the GO 1 st cited and instructions issued by the authority from time to time. It is the specific case of the petitioners that petitioner No.2 herein, named as the “Delhi World Public School” situated at Manneguda Village, Abdullahpurmet Mandal, Ranga Reddy District, had applied for an NOC from the State Government to proceed with the CBSE Affiliation, and the District Educational officer forwarded the proposal stating the school’s name as “Delhi World Public School”. But however, during the subsequent submission of proposal from the office of the Regional Joint Director to the Director of School Education (DSE) the name was changed to “Delhi World School”. In the proposal sent to the Director of School Education, the school’s name was mentioned as “Delhi World School” instead of “Delhi World Public School”. Consequently, the final NOC issued by the Government reflects the name “Delhi World School”. It is the specific case of the petitioners that all the primary statutory documents, including the School Opening Permission and the Extension of Temporary Recognition (ETR), bear the name “Delhi World Public School”, and the petitioners’ institution is already affiliated with Cambridge Early Years under the registered name “Delhi World Public School” and the school runs in accordance to International Standards and, therefore, it is important for retaining the school’s name with the word “Public” as “Delhi World Public School” instead of “Delhi World School”. It is further the case of the petitioners that though the detailed representation dated 02.12.2025 to that effect had been addressed to the 3 rd respondent herein, however no action had been initiated thereon as on date. 6. A bare perusal of the record indicates that vide Proc.Rc.No.168/A5/2024, dated 16.04.2024 of the District Educational Officer, Ranga Reddy District, provisional recognition/ETR had been granted in respect of the petitioners institution i.e. “Delhi World Public School”, Manneguda, Abdullapurmet Mandal, Ranga Reddy District for Classes PP to VII (EM) for the period from the academic year 2024-2025 to 2033-2034. 7. A bare perusal of the permission letter clearly indicates that name of the petitioners’ institution as “Delhi World Public School”, Manneguda, Abdullapurmet Mandal, Ranga Reddy District and hence this Court opines that representation of petitioner No.2 dated 02.12.2025 needs to be considered by the 2 nd and 3 rd respondents, duly taking into consideration the permission accorded to the petitioners institution vide Proc.Rc.No.168/A5/2024, dated 16.04.2024 of the District Educational Officer, Ranga Reddy District. 8. Taking into consideration : (a) The aforementioned facts and circumstances of the case, (b) The submissions made by the learned counsel appearing on behalf of the petitioners and the learned Assistant Government Pleader for Education, appearing on behalf of respondent Nos.1 to 4, (c) The contents of the petitioners representation dated 02.12.2025 (referred to and extracted above), (d) The provisional recognition/ ETR in respect of Delhi World Public School, Manneguda, Abdullapurmet Mandal, Ranga Reddy District vide Proc. Rc. Rc. No. 168/ A5/ 2024, dated 16.04.2024 (referred to and extracted above), (e) The discussion and conclusion as arrived at Para Nos.5 to 7 of the present order, The writ petition is disposed of directing the 2 nd and 3 rd respondents to consider the grievance of the petitioners as put forth by the petitioners vide petitioners representation dated 02.12.2025 addressed to the 3 rd respondent herein, seeking correction of petitioners’ I nstitution name in the proposal sent to Director of School Education for issuance of a No Objection Certificate, as “Delhi World Public School” Manneguda, Abdullahpurmet Mandal, Ranga Reddy District, instead of “Delhi World School”, duly taking into consideration the Proc. Rc. No. 168/ A5/ 2024, dated 16.04.2024 of the District Educational Officer, Ranga Reddy District issued in favour of the petitioner, in accordance to law, within a period of one (1) week from the date of receipt of a copy of the order and duly communicate the decision on petitioners representation dated 08.12.2025 to the petitioners herein. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any pending, in the Writ Petition shall also stand closed.
