ORDER : 1. Leave granted. 2. The appeal is only with respect to the condition imposed on the appellant to furnish security while permitting the appellant to withdraw the amount lying on the file of the Registrar General of the High Court of Delhi. 3. Even in the counter affidavit, it has not been denied that no appeal has been filed so far after the dismissal of the application under Section 34 of the Arbitration & Conciliation Act, 1996. Thus, there is no need for imposing the impugned condition. 4. In such view of the matter, the impugned order stands set aside to the extent of the condition imposed. The appellant is entitled to withdraw the amount lying on the file of the Registrar General of the Delhi High Court along with the accrued interest. We further observe that the statement in the counter affidavit would reveal that the respondent is in the process of filing an appeal before the Division Bench of the High Court. 5. The appeal is allowed accordingly. 6. Pending application(s), if any, shall stand disposed of.
