ORDER : M.G. UMA, J. The petitioners have approached this Court seeking issuance of writ in the nature of mandamus directing respondent No.4 to issue delegation form/representative to the Petitioners - Societies for voting and contesting in the upcoming general elections, which may be scheduled to be held during January 2026, by considering the representation made by the petitioners - Societies dated 07.12.2025 produced as per Annexures-F to F49. 2. Learned Senior advocate for the petitioners contended that till today, the calendar of events is not published, even though, the election in all probability may be held during January to 2026. Therefore, the only prayer that is made by the petitioners is to consider their representation dated 07.12.2025 produced as Annexures-F to F49. 3. Learned Senior advocate also contended that similar prayer was made by the petitioners in WP.No.36123/2025 and the said petition came to be allowed vide order dated 08.12.2025, directing respondent No.3 therein, to consider the similar representations submitted by the petitioners therein in light of the Government order dated 29.05.2025. 4. Learned counsel for respondent No.4 conceding that similar writ petition was filed by the petitioners therein in WP.No.36123/2025 and the same was allowed vide order dated 08.12.2025, but contends that, now respondent No.4 has already prepared and finalized the eligible voters list and the same is submitted to the State Election Authority. Under such circumstances, respondent No.4 may find it difficult to modify the earlier eligible voters list, which was forwarded to the State Election Authority. 5. The copy of order dated 08.12.2025 passed in WP.No.36123/2025 is produced for perusal of the Court. This Court, considering the Government order dated 29.05.2025 had extracted the relevant portion as under: and the petition was allowed, directing respondent No.3 therein to consider the representations submitted by the petitioners, in light of the said Government order dated 29.05.2025. 6. It is the contention of learned counsel for respondent No.4 that final eligible voters list is already submitted to the State Election Authority. But admittedly, the calendar of events is not yet published. Under such circumstances, I deem it appropriate to allow the petition, directing respondent No.4 to consider the representation produced as per Annexures-F to F49. If respondent No.4 considers the representation positively, and a situation arising for modifying the final eligible voters list already submitted to the State Election Authority, respondent No.4 will be at liberty to do so.
7. According, I proceed to pass the following: ORDER i) The petition is allowed. ii) Respondent No.4 is directed to consider the representation submitted by the petitioners dated 07.12.2025 produced as per Annexures-F to F49, in light of the Government order dated 29.05.2025, extracted in the body of the order, expeditiously atleast within 19.12.2025. iii) It is made clear that, if respondent No.4 considers the representation positively, which may give rise to modification of the final eligible voters list which is already submitted to the State Election Authority, respondent No.4 will be at liberty to submit the modified list in accordance with law.
