All these writ petitions were filed in relation to Recruitment Advertisement dated 18.09.2025 for recruitment on 575 posts of Assistant Professors in 30 subjects under Rajasthan Education Services (College Branch) Rules, 1986. These writ petitions raise common questions, therefore, they are tagged together and we are considering writ petitions with a common order. 2. The contention of the petitioner is that earlier 575 posts were advertised by RPSC for recruitment on post of Assistant Professor in 30 subjects vide notification dated 13.12.2024 and a corrigendum was issued on 10.01.2025. Thereafter, a fresh advertisement dated 18.09.2025 is issued by RPSC, for said recruitment. The RPSC contends that the advertisement dated 13.12.2024 and corrigendum dated 10.01.2025 has been withdrawn on 18.09.2025 and a public notification has been issued and published in all daily newspapers across the State of Rajasthan. 3. The controversy in the instant case are that RPSC is organizing examination from 07.12.2025 to 20.12.2025 but without duly publishing the syllabus of 30 subjects for which the recruitment process is initiated. After considering the submissions of learned counsel for the parties, on 02.12.2025, we directed to RPSC to submit an affidavit of the Secretary of RPSC with the details about release of syllabus, post advertisement dated 18.09.2025. Pursuant to order dated 02.12.2025 Mr. Ram Nivas Mehta, Secretary, RPSC, has filed an affidavit stating that the RPSC has uploaded revised syllabus on 08.10.2025 under the directions of the Chief Controller of Examination, RPSC, but the release date of syllabus was mentioned as 26.03.2025 as there was no change in previous syllabus. It has been mentioned that it was done under the written directions of the Chief Controller of Examination, RPSC, on 08.10.2025. 5. In support of the contention, the Joint Director, System Analyst, RPSC, issued a certificate on 02.12.2025 indicating that syllabus of 30 subjects for Assistant Professor (College Education), 2025 was uploaded on website on 08.10.2025 but release date was kept as 26.03.2025 as there was no change in syllabus. 5. A copy of internal note sheet is also placed on record which was in fact initiated in the office on 08.10.2025 and concluded with compliance on 08.10.2025. The RPSC has also submitted one Annexure RR/3 indicating that syllabus for 30 subjects was revised in the year 2020, 2023, March 2025 but syllabus of GK of Rajasthan, which is common for all subjects was revised in 2020. 6. During course of argument, Mr. Ramnivas Mehta, the Secretary, RPSC, has submitted printout of examination dashboard from RPSC portal which indicated as under: 7. The above document clearly indicated that syllabus was updated on 26.03.2025 but nowhere it has been mentioned that the syllabus has been updated on 08.10.2025. Similarly, the recruitment advertisement was updated on 13.10.2025 and application last date was 19.10.2025, whereas last date for editing in application was 29.10.2025. Besides above, the last updation is done on 28.11.2025 whereas in the instant writ petition Mr. M.F. Baig has accepted notice on behalf of RPSC on 26.11.2025. 8. Learned counsel appearing on behalf of petitioners referred a press note dated 26.03.2025 to show that the syllabus for recruitment examination for the post of Assistant Professor, (College Education Department), 2024 is uploaded/published on website of RPSC and same can be accessed in the name of http://rpsc.rajasthan.gov.in. This press note is signed by Mr. Ashutosh Gupta, who was Chief Controller of Examination, RPSC. 9. In the entire affidavit nowhere a statement is made that pursuant to advertisement dated 18.09.2025 the syllabus has been updated on website of RPSC, and followed by a press note. The Counsel appearing on behalf of RPSC and the Secretary have failed to answer the query posed to them about the difference in process adopted in previous examination and in current examination. We have considered the process adopted by RPSC in declaring scheduled date for conducting examination particularly without declaring the syllabus or keeping the suspense about the syllabus. 10. It is duty of every examination conducting body that the syllabus of the examination be published in advance to standardize what is to be tested so that all candidates are assessed against the same defined content and competency. The declaration of syllabus also makes the examination more transparent as the candidates can reasonably expect that the question paper will be framed within the notified syllabus and pattern. The syllabus also helps aspirants or the candidates to choose right books, notes, and reading material avoiding the unnecessary or irrelevant content. 11. The clearly defined syllabus is necessary for preparation of any competitive exam so that the candidate or the aspirant is able to know what to study, how deep to study, and on what parameters, he/she will be tested in the examination. If any public examination body fails to adopt fair and transparent procedure in conducting examination, it simply means that it is helping the coaching institutes which have become an almost unavoidable part of the competitive examination ecosystem and they are by and large damaging the system of public examination. Nowadays, the public examination bodies are normally adopting the methods adopted by the big coaching institutes, which has raised not only inequality among the candidates but in fact increased the commercialization in preparation of competitive examination. It is sufficient to ruin and destroy entire education system. 12. We are fully aware about the fact that 94,000 students have filed applications pursuant to advertisement dated 18.09.2025 to compete for 575 posts, therefore it is necessary for the RPSC first to declare or clarify about the syllabus of examination and then give 30 clear days to the candidates for appearing in the examination. Else, it will help and promote the ecosystem of commercial coaching institutes, who are already aware of questions, likely to come up and from which syllabus. A commercial network is well aware about the examination pattern and possible question Bank, used by the paper setters to prepare question papers for RPSC. These question banks are not available to a student, belong to poor and downtrodden class, particularly who hails from rural area. Thus, non- disclosure of syllabus in time also promotes discrimination, and the actions on part of RPSC are not sufficient to presume that RPSC is promoting a level playing field for all candidates. 13. I am so surprised that despite the serious allegation of malpractices in some of the previous examination from paper leak to paper selling and mass level cheating in the public examination conducted by the RPSC, still RPSC is pushing the opaque system and same is contrary to general principle of fairness and transparency. 14. Considering aforesaid, we are not satisfied with the submission of learned counsel for RPSC and the Secretary, RPSC that the syllabus of the examination was in fact published on 08.10.2025 and every candidate became aware about the publication of syllabus on 08.10.2025. Not a single document is available in public domain to show that the syllabus is published on 08.10.2025. 15. The RPSC has placed reliance upon internal noting and the certificate issued by Joint Controller, System (Analyst) but there is nothing available on internet which was accessed before the court by the Secretary of RPSC. If we consider that in intranet (within internal system of RPSC) the syllabus was uploaded on 08.10.2025 then there has to be a public mention of updation on exam dashboard but same is not available. The internal note sheet may be an afterthought process adopted by the RPSC so as to overcome the embarrassment faced in the instant case. Therefore, we disagree with the contention raised by learned counsel for RPSC or the Secretary, RPSC that the syllabus is uploaded and updated on 08.10.2025 pursuant to advertisement dated 18.09.2025. If any syllabus is published or updated or previously uploaded syllabus is adopted then there has to be a press note of 08.10.2025 as that of 26.03.2025. 16. Therefore, we disagree with the contention raised by learned counsel for RPSC or the Secretary, RPSC that the syllabus is uploaded and updated on 08.10.2025 pursuant to advertisement dated 18.09.2025. If any syllabus is published or updated or previously uploaded syllabus is adopted then there has to be a press note of 08.10.2025 as that of 26.03.2025. 16. In view of the reasons as assigned hereinabove the respondent-RPSC is directed to upload and publish syllabus for 30 subjects for which recruitment process was initiated pursuant to advertisement dated 18.09.2025 and only after 30 days of publication or uploading the syllabus, the examination be conducted for recruitment on 575 posts advertised vide advertisement dated 18.09.2025. 17. Till the time of publication of syllabus in public domain, no such examination shall be held pursuant to advertisement dated 18.09.2025. 18. List these petitions for final disposal on 15.12.2025. The counsel for RPSC is directed to file reply, if he desires to file, in remaining matters and if learned counsel for petitioner(s) desires to file rejoinder he may file within 3 days from date of receipt of copy of the reply. 19.
