JUDGMENT : Sanjay Kumar Dwivedi, J. Heard learned counsels for petitioner and for State 2. The petitioner is apprehending his arrest in connection with Masalia P.S. Case No.66 of 2024, for offence registered under section 311/103(1)/317(1)/55/56 of BNS, 2023 and section 27/25(1-B)a/26/35 of Arms Act, pending in court of learned Sub Divisional Judicial Magistrate, Dumka. 3. Learned counsel for petitioner submits that petitioner is not named in the FIR and his name has come in the investigation as well as confessional statement of the coaccused. He further submits that petitioner happened to be son of the Ramchandra Verma and he used to sit in the jewellery shop which is adjacent to the shop of the deceased and further allegations are there against Ramchandra Verma and Rajesh Verma who happened to be father as well as elder brother of the petitioner respectively and apart from that, there is nothing against the petitioner in the case diary also. 4. Learned State counsel opposes prayer and submits that petitioner happened to be son of Ramchandra Verma. 5. It transpires that the petitioner was used to sit on the jewellery shop of his father and this shop was adjacent to the shop of the deceased and the allegations of talk with the miscreants is there against Ramchandra Verma who happened to be father of the petitioner and one Rajesh Verma who happened to be elder brother of the petitioner and apart from that relation, nothing is there against the petitioner, and in the facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Dumka, in connection with Masalia P.S. Case No.66 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
