JUDGMENT : Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Nagri P.S. Case No.238 of 2023, for offence registered under section 394/302/201/34/120(B) of IPC, pending in court of learned Judicial Magistrate First Class, Ranchi. 3. Learned counsel for petitioner submits that false allegations are made against the petitioner and in the bottom of the FIR wife of the deceased has stated that money transaction was frequent between the husband of the informant and Uttam Kumar Mishra son of Muni Mishra. He further submits that subsequently she has gone to the police station along with Uttam Kumar Mishra and has stated there that Uttam Kumar son of Kamal Kant Mishra is the accused. He submits that apart from that there is nothing against the petitioner and only on suspicion name of the petitioner has come in the case diary. 4. Learned State counsel opposes prayer and submits that the informant has gone along with the named accused Uttam Mishra son of Muni Mishra and has stated that this petitioner who is son of Kamal Kant Mishra is the main accused. 5. In the case diary it has come in paragraph no.50 that the informant along with Uttam Kumar Mishra son of Muni Mishra has gone to the police station and has stated that the petitioner who is son of late Kamal Kant Mishra is the main accused and it appears that it is the after-thought and apart from that, nothing is there in the case diary against the petitioner and in the facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Ranchi, in connection with Nagri P.S. Case No.238 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita ( BNSS ), 2023.
