JUDGMENT : Subba Reddy Satti, J. 1. Notice before admission. 2. Heard Sri G.V.S. Kishore Kumar, learned counsel for the petitioner and Sri Ramalingeswar Rao, learned Government Pleader for Services-II, for the respondents. 3. The petitioner, Hostel Welfare Officer, Government BC Boys Hostel, Jonnalagadda, NTR District, earlier filed W.P.No.24861 of 2024, impugning the proceedings issued by respondent No.3 District Collector, NTR District vide Rc.No.A1/92/2024 dated 15.10.2024 suspending the petitioner, under Rule 8 of the Andhra Pradesh Civil Services / CCA Rules, 1991, pending the inquiry. The said proceedings were suspended by this Court by order dated 04.11.2024. The petitioner filed C.C.No.4615 of 2024, complaining non-implementation of order dated 04.11.2024. 4. The present writ petition is filed to declare the action of respondent No.3 in not reinstating the petitioner in pursuance of order dated 04.11.2024 in I.A.No.1 of 2024 in W.P.No.24861 of 2024 and also non-payment of salary from 21.09.2024 in terms of G.O.Ms.No.29 dated 09.03.2011. 5. Learned Government Pleader for Services-II would fairly submit that against the order dated 04.11.2024 in I.A.No.1 of 2024 in W.P.No.24861 of 2024, the State has not filed any appeal. 6. In that view of the matter, once the order of suspension was suspended by this Court, learned respondent No.3 should have reinstated the petitioner with immediate effect. In fact, as narrated supra contempt case is also filed and the same is pending. 7. Learned counsel for the petitioner would submit that the petitioner has been suffering from cancer and he made representation dated 09.11.2024 to respondent No.2 to continue on medical leave and also to process his salary in view of the order dated 04.11.2024 in W.P.No.24861 of 2024. The said representation did not evoke any response. 8. Given the facts and circumstances of the case, there shall be interim direction to respondent No.3 to issue reinstatement orders forthwith to the petitioner. Upon such reinstatement order respondent No.5 shall upload the salary bill of the petitioner in terms of G.O.Ms.No.29 dated 09.03.2011. 9. Respondents 3 and 5 shall report compliance by the next date of hearing. In case of failure on the part of respondents 3 and 5 to comply with the directions, they shall appear before the Court on the next date of hearing Post on 12.02.2025.
