ORDER : 1. Having heard learned counsel for the parties, we do not find any good ground and reason to interfere with the impugned judgment, convicting the appellants under Sections 147 and 326 read with Section 149 of the Indian Penal Code, 1860. 2. We are informed that the appellants have already paid the fine of Rs. 20,000/- (Rupees twenty thousand only) imposed on each one of them. 3. On the question of sentence, it is pointed out that appellant No. 1, Parashuram, has already undergone sentence of 51/2 months. The other appellants, namely, Seetaram, Gopal, Suresh, Vijay Kumar, Sanju, Laxman, Manik, Dasharath, Ramesh, Kamalakar and Chandrashekhar @ Chandru have undergone sentences varying between 28 days and 49 days. 4. The offence in question relates to the year 2007. The appellants were not involved in any other offence. It is also stated that this was their first offence. 5. Having regard to the facts and circumstances of the case, we exercise our power under Section 401 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ["BNSS", for short] and direct release of the appellants on probation. They shall execute bonds before the trial Court to the required effect for a period of two years and, in the meantime, shall keep peace and be of good behaviour. 6. Further, the appellants will jointly pay an additional sum of Rs. 1,00,000/- (Rupees one lakh only), which will be treated as compensation and will be paid to Vikas (PW-5) as per Section 395 of the BNSS/Section 357 of the Code of Criminal Procedure, 1973. The said amount will be deposited in the trial Court within a period of six weeks from today and will be disbursed by the trial Court to Vikas (PW-5). 7. Accordingly, the order of sentence will stand modified in the above terms. The appeal is partly allowed and disposed of. 8. We clarify that appellant No. 2, Seetaram, will not be removed from service if he is already working, on the basis of his conviction and the order passed by this Court. This direction is issued by exercising the power under Article 142 of the Constitution of India. 9. Pending application(s), if any, shall stand disposed of.
