ORDER : V. Lakshminarayanan, J. The petitioner seeks for issuance of a Writ of Mandamus directing the 1st respondent to renew the passport bearing No.M8455007 to the petitioner's husband based on his application for renewal cum re-issue passport on 17.03.2025 within a stipulated time. 2.The petitioner's husband is employed in Sharjah. His mother passed away on 03.05.2025. When he approached the Indian Embassy at Sharjah in UAE, he was informed that there is a criminal case pending and therefore, his passport would not be extended. 3.I heard Mr.B.Kalaiyarasan for the petitioner and Mr.M.Sathyam, learned Central Government Standing Counsel for the 1st respondent. 4.In terms of the notification issued by the Ministry of External Affairs in G.S.R.570(E) dated 25.08.1993, mere pendency of a criminal case is not a bar for issuance of passport. Since the petitioner states that her husband has been appearing regularly before the learned Judicial Magistrate No.2, Kallakurichi, there shall be a direction to the respondents to issue the passport for a period of one year to enable the petitioner's husband to travel to India and attend the funeral obsequies on 06.06.2025. 5.Accordingly, this writ petition is ordered. No costs.
