ORDER : 1. This petition is filed under Section 406 of the Code of Criminal Procedure seeking transfer of Criminal Case No. 182 of 2023 titled Satya Pal Giri vs. Vishnu and Others pending in the Court of learned Civil Judge/Judicial Magistrate, Anoopshahar, District Bulandshahar, Uttar Pradesh to the Court of Chief Judicial Magistrate, District-South- East, Saket Court, New Delhi. 2. Despite repeated calls and pass over, none enters appearance on behalf of the respondent. 3. The ground raised by the petitioners for seeking the transfer is that they cannot afford frequent trips at Bulandshahar, Uttar Pradesh. 4. On consideration of the matter in totality, we are of the view that the transfer can be allowed. Consequently, the Transfer Petition is allowed. 5. Accordingly, Criminal Case No. 182 of 2023 titled Satya Pal Giri vs. Vishnu and Others pending in the Court of learned Civil Judge/Judicial Magistrate, Anoopshahar, District Bulandshahar, Uttar Pradesh is transferred to the Court of Chief Judicial Magistrate, District-South-East, Saket Court, New Delhi. 6. The Court of Civil Judge/Judicial Magistrate, Anoopshahar, District Bulandshahar, Uttar Pradesh shall transfer the records pertaining to the said case to the transferee court, as expeditiously as possible. 7. Parties are directed to appear before the concerned Court on 27th February, 2025. 8. The Respondent is permitted to attend the proceedings virtually, unless his presence is required by the trial Court. 9. Pending applications, if any, shall stand disposed of.
