ORDER : S.M. SUBRAMANIAM, J. All these writ petitions are relating to the consecration function of Arulmigu Subramaniya Swamy Temple, Thiruchendur, scheduled to be held on 07.07.2025. 2. In W.P.(MD) No.17301 of 2025, the Joint Commissioner /Executive Officer of the Temple has filed a counter affidavit, wherein in paragraph Nos.5 to 7, it has been stated as follows : “5.The 5 th respondent temple respectfully submits that with regard to the proposed Consecration / Kuda, ulakku concerned, starting from the fire ritual enclosure (yagasalai) to the final consecration (Maha Kumbhabhisegam) extensive arrangements have been made by the 5 th respondent temple administration to conduct it in Tamil scared songs and hymns as well. This resonpondents have also made arrangements to recite and chanting of Panniru Thirumurai in each time interval during the poojas and rituals at the Yagasalai in the 5 th respondent temple will be performed during the festival of proposed Consecration / Kudamulakku. 6.The 5 th respondent temple respectfully submits that at the Consecration / Kudamulakku to be held at the Arulmigu Subramanyaswami Temple, Thiruchendur, 108 Ooduva Moorthis will perform a grand recitation of Aganda Parayanam namely the ancient Tamil vedic matras from 5:00 am to 9:00 p.m. everyday i.e., from 01.07.2025 to 07.07.2025. 7.The 5 th respondent temple respectfully submits that Arrangements have been made by this respondents to recite and chanting of Panniru Thirumuraigals, Thirupughal and Kandhar Anubhoothi, and the complete recitation of the ancient Tamil vedas, with 64 Odhuvamurthys, from 7:00 am to 1:00 pm and from 4:00 pm to 9:00 pm from 01.07.2025 to 07.07.2025 on the above said days of Velvi Salai worship [sacred fire ceremony]. Therefore, in the 5 th respondent temple administration have made effective arrangements to recite and chant of Tamil hymns/verses, Panniru Thirumuraigal during Kudamulakku primarily, along with Sanskrit hymns/vedas during Kudamulakku/Consecration.” 3. As per the above said counter affidavit, the procedures prevailing are being followed by the Temple authorities. 4. The petitioners are unable to establish any right for grant of the relief as such sought for in the present writ petitions. In the absence of any right, Court cannot issue any such direction. It is needless to state that the procedures contemplated under the H.R.& C.E.Act and the Rules framed thereunder are to be followed for administering the temple functions. If there is no provision, then the Government should recognize certain practices or the Commissioner should recognise certain practices, as the case may be, which are prevailing in a particular temple. However, such disputed claims cannot be decided by the High Court in a writ petition. These are all certain affairs, which are all to be considered by the H.R. & C.E. Department or the officers empowered under the provisions of the Act. 5. Thus, the petitioners are at liberty to approach the Commissioner, H.R. & C.E.Department for redressal of their grievance. On receipt of such representation, the Commissioner, H.R.& C.E.Department shall look into the same and take appropriate decision on merits and in accordance with law. 6. It is to be noted that there cannot be any discrimination in the matter of treating the devotees or permitting the devotees to equally participate in the temple festival. 7. With the above observation, these writ petitions are dismissed. No costs. Consequently, connected miscellaneous petition is closed.
