ORDER : This Writ Petition has been filed with the following prayer:- “Writ of Mandamus, directing the respondents herein more particularly the 2nd respondent herein to consider petitioner representation dated 09.06.2022, 26.07.2022, and 22.08.2022 and pass appropriate orders to release his retirement benefits to the tune of Rs.41,50,448.90/- (Forty One Lakh Fifty Thousand Four Hundred and Forty Eight Rupees Ninety Paisa Only) and pass appropriate orders to that effect within a time stipulated by this Court.” 2.The facts of the case in a nutshell, led to filing of this Writ Petition and necessary for disposal of the same, are as follows:- a) The petitioner joined service as Jewel Appraiser with co-operative training on 23.10.1982 in the Karur Town Co-operative Bank Limited and on attaining the age of superannuation, he retired from service as General Manager on 31.05.2022. After retirement, out of Rs. 41,50,448.90/-, the second respondent, by a letter, dated 09.06.2022, released an amount of Rs.6,00,369.45/-, which is a part of total Provident Fund Dues, towards retirement benefits to the petitioner. b) As his retirement benefits were not fully released by the respondents, the petitioner had made several representations to the respondents and the last representation was dated 22.08.2022, copy of which was found place at Page Nos.26 and 27 of the paper book, but the balance amount payable by the respondents was not paid so far to the petitioner by the respondents nor the representations of the petitioner were considered. Thus, being no other alternative, the petitioner has filed the present Writ Petition seeking the relief as stated supra. 3. Heard Mr.I.Velpradeep, learned counsel for the petitioner and Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondents. 4. The learned counsel for the petitioner, while reiterating the averments made in the affidavit filed in support of this Writ Petition, submits that in spite of more than two years have lapsed, the respondents are sitting tight over the matter and had not passed any positive order in favour of the petitioner. Thus, he submits that the respondents may be directed to consider the claim of the petitioner in accordance with law within the time stipulated by this Court. 5. Mr.D.Sadiq Raja, learned Additional Government Pleader for the respondents submits that the petitioner may be directed to file a fresh representation before the second respondent/The Managing Director, The Karur Town Co-operative Ltd 924, 92, Mellu Street, Karur 639 001, along with his grievances as well as the claim and this Court may please to fix time to decide the same by way of a reasoned and a speaking order in accordance with law within the time stipulated by this Court, as no useful purpose will be served in keeping the present Writ Petition pending before this Court. 6. After considering the arguments as advanced by the learned Counsels for the parties, after perusal of the entire records and the pleadings made in the Writ Petition and after perusal of the representations dated 09.06.2022, 26.07.2022 and 22.08.2022 made by the petitioner before the respondents and also the request made by the learned Additional Government Pleader, this Court deems it appropriate that no useful purpose will be served in keeping this Writ Petition pending before this Court. 7. Accordingly, the petitioner is directed to file a fresh representation before the second respondent/The Managing Director, The Karur Town Co-operative Ltd 924, 92, Mellu Street, Karur 639 001, bringing his claim and grievances along with a copy of this order and also annexing a copy of the representations dated 09.06.2022, 26.07.2022 and 22.08.2022 within a period of two weeks from today. If any such representation is filed by the petitioner as per the time stipulated by this Court, the second respondent/The Managing Director, The Karur Town Co-operative Ltd 924, 92, Mellu Street, Karur 639 001, is directed to consider the same and pass a reasoned and a speaking order in accordance with law after giving an opportunity of hearing to the petitioner, within a period of six weeks from the date of receipt of such representation. The second Respondent/The Managing Director, The Karur Town Co-operative Ltd 924, 92, Mellu Street, Karur 639 001, shall communicate the order/decision to the Petitioner through Registered Post with Acknowledgement Due (RPAD) within a period of two weeks from the date of passing the order/decision. 8.
