ORDER : 1. Having regard to the facts and circumstances of the present case; the role allegedly attributed to the appellant, Mustafa Johar Vana, and the period of incarceration suffered by him, we accept the present appeal and direct that the appellant, Mustafa Johar Vana, shall be released on bail during the pendency of the trial in connection with First Information Report/C.R. No.11210046201139/2020 dated 05.09.2020 registered with Police Station - Puna, Surat City, Gujarat, for the offence(s) punishable under Sections 8(c), 22(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, on terms and conditions to be fixed by the trial court. 2. In addition to the terms and conditions fixed by the trial court, the appellant, Mustafa Johar Vana, shall provide the mobile number on which he can be contacted by the Investigating Officer/Station House Officer of the concerned police station to ascertain his whereabouts, while he is on bail. Recording the aforesaid, the appeal is allowed and disposed of in the above terms. 3. We clarify that the observations made in this order are for the disposal of the present appeal and for grant of bail and the same shall not be treated as an expression of opinion on the merits of the case. 4. Pending application(s), if any, shall stand disposed of.
