ORDER : 1. Heard learned counsel for the petitioners. 2. An advertisement was issued on 17.08.2022 inviting applications for 1457 posts of Craft Instructors in the Industrial Training Institutes. 3. The prescribed qualification for the said post was Diploma in Engineering or Technology of the branch concerned. The advertisement specifically vide clause 8.1 provided that the candidates possessing higher qualification in the respective trades would be considered eligible. 4. The High Court in dismissing the writ petition arising from the order of the Maharashtra Administrative Tribunal, whereby the challenge thrown by the petitioner to the selection of candidates possessing higher qualification was rejected, held that there is no dispute that the degree in Engineering in the respective trades is a higher qualification than diploma in Engineering in that trade and therefore, the selected candidates were eligible and entitled for appointment. 5. Moreover, the Rules do not prohibit higher qualification as ineligible and the petitioner has not challenged the advertisement which provides for eligibility of higher qualification for supplying, meaning thereby that the petitioner accepts the said condition. 6. In the aforesaid facts and circumstances, we do not deem it necessary to interfere in the matter and the Special Leave Petition is, accordingly, dismissed. Pending application(s), if any, shall stand disposed of.
