ORDER : T.P. (C) NO. 1445 OF 2024 1. Heard learned counsel for the parties. 2. The transfer petition is filed by the petitioner-wife seeking transfer of the application filed by the respondent-husband for dissolution of marriage under Section 13 of the Hindu Marriage Act, 1955, which is subject matter of Case being Matrimonial Petition No. 172/2024 titled as "Vikas Chaudhary Vs. Anju Dagar" pending in the Court of the Principal Judge, Family Court, Bijnor, Uttar Pradesh to the competent Court at Panchkula, Haryana. 3. Having regard to the distance between the two Courts, i.e., Court at Bijnor, Uttar Pradesh and Court at Panchkula, Haryana, as also to the fact that the petitioner is working as a teacher in a school, where the children of the petitioner are studying, and also the fact that the maintenance petition filed by the petitioner - wife is already pending at Bijnor, Uttar Pradesh, we are inclined to accept the present petition. 4. In that view of the matter, we direct transfer of Case being Matrimonial Petition No. 172/2024 titled as "Vikas Chaudhary Vs. Anju Dagar" from the Court of the Principal Judge, Family Court, Bijnor, Uttar Pradesh to the competent Court at Panchkula, Haryana. 5. The records of the case be transferred forthwith to the transferee Court. 6. Further, liberty is granted to the respondent-husband to move an appropriate application before the transferee Court for seeking permission to participate in the proceedings virtually. If such a request is made, the transferee Court may pass appropriate order as it may deem fit. 7. The Transfer Petition is allowed. 8. Pending application(s), if any, shall stand disposed of. T.P.(CRL.) NO. 627 of 2024 1. This transfer petition has been filed by the petitioner-husband seeking transfer of the application filed by the respondent-wife for grant of maintenance under Section 125 of Cr.P.C., which is subject matter of Case being Petition No. 163/2023 titled as "Anju Dagar & Ors. Vs. Vikas Chaudhari" pending in the Court of the Principal Judge, Family Court, Panchkula District - Panchkula Haryana to the District Family Court, Bijnor, District-Bijnor (U.P.). 2. Since, we have allowed the transfer petition being T.P. (C) No. 1445 OF 2024 filed by the petitioner - wife seeking transfer of application filed by the petitioner - husband being Matrimonial Petition No. 172/2024 titled as "Vikas Chaudhary Vs. 2. Since, we have allowed the transfer petition being T.P. (C) No. 1445 OF 2024 filed by the petitioner - wife seeking transfer of application filed by the petitioner - husband being Matrimonial Petition No. 172/2024 titled as "Vikas Chaudhary Vs. Anju Dagar" from the Court of the Principal Judge, Family Court, Bijnor, Uttar Pradesh to the competent Court at Panchkula, Haryana, we are not inclined to accept the present transfer petition. 3. The Transfer Petition is, accordingly, dismissed. 4. Pending application(s), if any, shall stand disposed of.
