ORDER : IA No. 154221/2024 1. Delay condoned. 2. Heard Mr. Sudhir Kumar Saxena, learned senior counsel appearing for the applicant, who has filed application for modification of this Court's order dated 17.05.2024. 3. The counsel argues that although the accused Rishi Kumar Verma was present at home when his wife died by hanging, a contrary misrepresentation was made to this Court and on that basis, bail was granted to the accused. 4. The pleadings and the relevant records are referred to by the counsel to point out that the accused was very much present in the residence but he claimed wrongly that he was not present, when his wife died. Therefore, it is argued that bail order should be recalled as it was obtained through misrepresentation. 5. The above submission of the applicant's counsel is supported by Mr. Yasharth Kant, learned counsel appearing for the State of Uttar Pradesh. The State has filed an affidavit supporting the contention made against the accused. 6. Having considered the above and more particularly the CCTV footage which indicates that the accused was present at the place of occurrence, we deem it appropriate to recall the bail order dated 17.05.2024 passed in SLP (Criminal) No. 5200 of 2024. In view of this, application for modification and miscellaneous application stand disposed of with pending application(s), if any. 7. The SLP (Criminal) No. 5200 of 2024 is restored and is taken on Board. As the accused after securing bail order has remained absent from this proceeding, the State is directed to arrest the accused - Rishi Kumar Verma and take him into custody. The Special Leave Petition stands dismissed. It is ordered accordingly. 8. Needless to say that the above observation against the accused is made only in the context of the bail order passed by this Court on 17.05.2024. The same will have no bearing in the on-going trial where we are told by the Government counsel that the accused is participating. 9. Pending application(s), if any, shall stand closed.
