ORDER : (VINIT KUMAR MATHUR, J.) Heard learned counsel for the parties. 2. In the present writ petitions, the question has been raised by the petitioners with respect to the quality of materials used for constructing the Panchayat Bhawan at Jetdasar, Tehsil Baap, District Jodhpur. 3. Learned counsel for the petitioners has pointed out number of infirmities in construction work undertaken for Panchayat Bhawan including one that the land which is used for construction of the Panchayat Bhawan is less than the required parameters given by the State Government. He, therefore, requests that the construction work may be supervised by the Senior Officers of the Panchayati Raj Department. Learned counsel also submits that this Court may also pass a direction to get the construction work of the Panchayat Bhawan supervised through the Superintending /Executive Engineer of PWD Station at Phalodi. 4. Learned counsel for the respondent submits that large part of construction of Panchayat Bhawan has already been done and the construction, which was of a poor quality has already been broken down, dismantalled and, therefore, it is clear that the respondents are taking proper care for undertaking the construction of building with superior quality. On the submissions made by learned counsel for the petitioner with respect to supervision of construction activity, learned counsel for the respondent State assures that the construction work will now be supervised by the Senior Officers of the Panchayati Raj Department. 5. The submissions made by learned counsel for the respondents are accepted by learned counsel for the petitioners and he submits that the petitioners are the Villagers and their only concern is that the construction work of the Panchayat Bhawan should be of the best quality. 6. Considering the submissions made at the Bar, both the writ petitions are disposed of with a direction to the respondents to get the work done of the Panchayat Bhawan at the earliest. The respondents are also directed to ensure the quality of work done and if the same is found to be of inferior quality then take stern action against the erring officers. 7. It is also ordered that the construction work will be done under the supervision of Senior Officers of the Panchayat Samiti Baap, District Jodhpur. 8. It is also ordered that the Superintending/Executive Engineer of the PWD at Phalodi shall also inspect the site from time to time and he will check all the parameters of the construction and if he finds that the construction activities are not undertaken in accordance with the norms and the quality is compromised then he will be at liberty to take appropriate steps for correcting the same. 9. The stay application and other pending applications, if any, also stand disposed of.
