JUDGMENT : ANIL KUMAR CHOUDHARY, J. Heard the parties. 2. This Writ Petition (Cr.) under Article 226 of the Constitution of India has been filed inter alia with a prayer for issuance of appropriate writ/order/direction commanding upon the Respondent Authorities to register the First Information Report in connection with cognizable offence having been committed, by which the son of the petitioner was robbed, assaulted and was thrown before a running train which resulted in his right leg being amputated and commanding upon the respondents to immediately take into custody the accused persons of the case. 3. It is submitted by the learned counsel for the petitioner that as is evident from the counter affidavit, Patratu P.S. Case No.139 of 2023 has already been registered on the basis of the written application submitted by the son of the petitioner and it is submitted that the respondents be directed to ensure fair and proper investigation of the case and expedite the same considering the view that the FIR was lodged on 28.07.2023. Hence, it is submitted that the modified prayer as prayed for, in this writ petition, be allowed. 4. Learned counsel appearing for the State submits that respondents are duty bound to investigate the Patratu P.S. Case No.139 of 2023 and will take the investigation to its logical conclusion and will certainly take steps for expeditious completion of the investigation of the Patratu P.S. Case No.139 of 2023 and investigation is in fact going on. 5. Having heard the rival submissions made at the Bar and after considering the facts and circumstances of the case, since the FIR has already been registered, this writ petition is disposed of with a direction to the Respondent Authorities to ensure that free and fair investigation of the Patratu P.S. Case No.139 of 2023 be taken up and the investigation of the case be conducted in an expeditious manner and to submit Final Report preferably within a period of three months from the date of this order. 6. This W.P. (Cr.), stands disposed of accordingly.
