ORDER : Anil K. Narendran, J. This report filed by the Special Commissioner, Sabarimala is regarding the alleged collection of funds by the Coordinator of ‘Punyam Poonkavanam’ Project at Erumeli. The said fact was brought to the notice of the Special Commissioner, by the District Police Chief, Kottayam, vide Annexure 1 letter dated 08.03.2023. 2. On 21.03.2023, when this SSCR came up for consideration, the learned Senior Government Pleader made available for the perusal of this Court the ‘Bandobast Scheme’ by the Kerala Police for Sabarimala festival season of 1198ME (2022- 23). Page No.37 of the Bandobast Scheme deals with ‘Punyam Poonkavanam’ Project, wherein it is stated that ‘Punyam Poonkavanam’ Project has been implemented in Sabarimala since 2011 as a Community Policing Programme with an intention to keep Sannidhanam, Pampa and its surroundings clean, with the active participation and coordination of all the devotees. The Special Officers/Police Controllers at Sannidhanam, Pampa and Nilakkal are to render all necessary assistance to ‘Punyam Poonkavanam’ Project, who will also ensure that the barracks, mess, toilets, etc., and the surroundings are kept clean and hygienic throughout the season. 3. In Paragraph 4 of the order dated 21.03.2023, this Court noticed the submission made by the learned Standing Counsel for Travancore Devaswom Board regarding another project by the name ‘Pavithram Sabarimala’, which was launched by the Board, during Sabarimala festival season of 1198ME (2022- 23), which is a cleaning project by the employees of the Board at Sabarimala, Pampa, etc., for daily routine cleaning activities in Sabarimala. 4. By the order dated 21.03.2023, this Court directed the 5 th respondent Chief Police Coordinator, Sabarimala and also the Secretary of the 2 nd respondent Travancore Devaswom Board to file detailed affidavits, within three weeks, regarding the activities undertaken under ‘Punyam Poonkavanam’ Project and ‘Pavithram Sabarimala’ during the festival season of 1198ME (2022-23). The 5 th respondent was directed to explain in the said affidavit whether there is any collection of funds from the devotees or through sponsorship in connection with any activities under ‘Punyam Poonkavanam’ Project. 5. On 11.04.2023 when this SSCR came up for consideration, the learned Senior Government Pleader submitted that the 5 th respondent Chief Police Coordinator, Sabarimala, has already ordered an enquiry through the District Police Chief, Kottayam, on the alleged collection of funds by the Coordinator of ‘Punyam Poonkavanam’ Project at Erumeli and that the enquiry is going on. 5. On 11.04.2023 when this SSCR came up for consideration, the learned Senior Government Pleader submitted that the 5 th respondent Chief Police Coordinator, Sabarimala, has already ordered an enquiry through the District Police Chief, Kottayam, on the alleged collection of funds by the Coordinator of ‘Punyam Poonkavanam’ Project at Erumeli and that the enquiry is going on. By the order dated 11.04.2023, this Court directed the 2 nd respondent Travancore Devaswom Board and also the 5 th respondent Chief Police Coordinator to take necessary steps to ensure that there is no collection of funds from devotees or through sponsorship in connection with the ‘Punyam Poonkavanam’ Project or ‘Pavithram Sabarimala’. 6. In Paragraph 5 of the affidavit dated 22.07.2023 filed by the 5 th respondent Chief Police Coordinator, Sabarimala [Additional Director General of Police (Law and Order)], it is stated that on the basis of information regarding the acceptance of donation by a police official attached to Nilakkal Police Station, departmental action has been initiated and the delinquent employee has been placed under suspension. As directed by the Chief Police Coordinator, the District Police Chief, Kottayam conducted an enquiry and submitted a report. The enquiry report is extracted in paragraph 5 of the affidavit dated 22.07.2023. Paragraphs (iii) and (iv) of that report, which are extracted in paragraph 5 of the affidavit dated 22.07.2023, are reproduced hereunder; “(iii) The activities in this season of Punyam Poonkavanam Project in Erumeli area were under the Co-ordinator Sri. G. Asoka Kumar, Assistant Commandant retired from DHQ Ernakulam and Sri. Shibu M.S, retired Sub Inspector, Kanjirappally PS and Sri. Navas K.I, SCPO 6875 and Sri. Vishal V Nair, CPO 7526 were associated with the project in previous years also. Sri. Anish CPO 7988 was dissociated from this project subsequently due to some differences with the other Police personnel. (iv) An enquiry was conducted by the Inspector of Police, Erumeli Police Station and revealed the following facts. Bhima Jewellers Bengaluru Group prepared cloth bags for distribution free of cost to the devotees at Sannidhanam. Since the cloth bags contained the advertisement of Bhima Group of Jewellers, and the same cannot be distributed at Sannidhanam due to the orders of the Hon'ble High Court, the bags were sent to Erumeli by Armed Police Sub Inspector Sri. Bhima Jewellers Bengaluru Group prepared cloth bags for distribution free of cost to the devotees at Sannidhanam. Since the cloth bags contained the advertisement of Bhima Group of Jewellers, and the same cannot be distributed at Sannidhanam due to the orders of the Hon'ble High Court, the bags were sent to Erumeli by Armed Police Sub Inspector Sri. Anil of KAP 3 rd Battalion, who was coordinating the Punyam Poonkavanam Project at Sannidhanam and the Bhima Group handed over around 95,000 cloth bags (about 200 packs) to the Punyam Poonkavanam volunteers of Erumeli, which was received by Sri. Shibu M.S, retired Sub Inspector, Sri. Navas K I, SCPO, Sri. Aneesh, CPO, Sri. Vishal V Nair, CPO were stored at Punyam Trust Office (an NGO) at Kulapuram in Kanjirappally Police Station limits. The same was distributed to Ayyappa devotees and local public through Punyam Poonkavanam Co-ordinators, Vyapari Vyavasayi Ekopana Samiti, Erumeli, Vyapari Vyavasayi Samiti and other commercial establishments in Koovapally, Kanjirappally, Mundakkayam, Kalaketti areas and shops nearby Koratti Siva Temple and other temples in areas from Kanjirappally 26 th mile to Kalaketti Koikakkav sector. The Vyapari Vyavasayi Ekopana Samiti, Erumeli and other traders at Erumeli stated that the cloth bags were distributed to the devotees and local public through volunteers and from shops free of cost. It is reported that around 25,000 cloth bags (25 packets) are still stocked at one Punyam Trust office at Kulapuram.” 7. In paragraph 8 of the affidavit dated 22.07.2023, the 5 th respondent Chief Police Coordinator, Sabarimala, has furnished the address of ‘Punyam Poonkavanam’ in the printed brochures, which is as follows; Office of Punyam Poonkavanam, Sannidhanam, Sabarimala, Pathanamthitta District, Kerala. www.punyampoonkavanam.org facebook.com/PunyamPoonkavanam ppkhelpline@gmail.com/9847800100 Punyam Poonkavanam, Chytanya, 24/3288, Belhaven Garden, Kowdiar, Thiruvananthapuram-695003. By the order dated 26.06.2023 in I.A.No.1 of 2023 filed by Rakesh V.M. and M. Amba Shanker, they were impleaded as additional respondents 8 and 9 in this SSCR. In the affidavit filed in support of that interlocutory application, it is stated that ‘Punyam Poonkavanam’ Project is a participatory environmental community policing initiative, and they have been voluntarily associating with the project since its inception in 2011. In the counter affidavit dated 02.08.2023 filed by additional respondents 8 and 9, which is one sworn to by the additional 8 th respondent – Rakesh V.M., it is stated that he became a volunteer of the project in the year 2014 and remained as a fellow traveller of the project since then. 9. An affidavit dated 08.08.2023 has been placed on behalf of the 2 nd respondent Travancore Devaswom Board. Respondents 8 and 9 have filed an affidavit dated 25.09.2023. 10. On 04.10.2023, during the course of arguments, the learned Standing Counsel for Travancore Devaswom Board has made available for the perusal of this Court a multi-colour brochure published in the name of ‘Punyam Poonkavanam’, running to 35 pages. Screenshots of the front and back cover pages of the brochure published by ‘Punyam Poonkavanam’ are reproduced hereunder; In the said brochure the name of the additional 8 th respondent - Rakesh V.M. is printed as Coordinator, Punyam Poonkavanam Project, which reads thus; For more details: Rakesh V.M. Two screenshots of the inner pages of the brochure published by ‘Punyam Poonkavanam’, which are extracted in paragraph 8 of the order dated 04.10.2023, are reproduced hereunder; In page No.19 of the brochure published by ‘Punyam Poonkavanam’, it is stated that ‘Punyam Poonkavanam Kendras’ were opened across Kerala, Andhra Pradesh, Telangana, Tamil Nadu, Karnataka, New Delhi and other States as well as in foreign countries like Abu Dhabi, Bahrain, Singapore and Malaysia. 12. In the affidavit dated 22.07.2023, the 5 th respondent Chief Police Coordinator, Sabarimala has stated that ‘Punyam Poonkavanam Project’ was initiated in the year 2011 by the then Special Officer, Sabarimala. Subsequently, the project found a place in the Police Bandobast Scheme for Sabarimala festival. +91 9847 800 100 infor@punyampoonkavanam.org 13. In the affidavit dated 22.07.2023, the 5 th respondent Chief Police Coordinator, Sabarimala has stated that ‘Punyam Poonkavanam Project’ was initiated in the year 2011 by the then Special Officer, Sabarimala. Subsequently, the project found a place in the Police Bandobast Scheme for Sabarimala festival. The Special Officers at Sannidhanam, Pamba and Nilakkal were directed to provide assistance to the project at Sannidhanam, Pamba and Nilakkal. It is understood that ‘Punyam Poonkavanam’ Project was initiated at Erumeli in the year 2016, but no directions were seen issued from the Police Department for providing any assistance at Erumeli in the Police Bandobast Scheme. In the said affidavit, it is stated that the office bearers of ‘Punyam Trust’, a charitable trust with registration No.0083/4-2021 formed in the year 2021 with its office at Kulappuram, Kanjirappally Police Station limits (referred to in paragraph (viii) of the enquiry report submitted by the District Police Chief, Kottayam) and the coordinators of ‘Punyam Poonkavanam’ Project at Erumeli are one and the same. 14. On 04.10.2023, after perusing the brochure of ‘Punyam Poonkavanam’ printed by the additional 8 th respondent as Coordinator, Punyam Poonkavanam Project, the learned Senior Counsel for additional respondents 8 and 9 sought time to get instructions, through the instructing counsel, and to file an additional affidavit of the said respondents explaining the facts and circumstances. After considering the pleadings and materials on record and also the submissions made at the Bar, this Court by a detailed order dated 04.10.2023 directed the 5 th respondent Chief Police Coordinator [Additional Director General of Police (Law and Order)], Sabarimala, to conduct an enquiry into the aforesaid aspects and submit a preliminary report before this Court within a week. 15. In the order dated 04.10.2023, this Court noticed that ‘Punyam Poonkavanam’ Project is a community policing programme implemented in Sabarimala since 2011, during Mandala-Makaravilakku festival seasons, as part of the Police Bandobast Scheme, with an intention to keep Sannidhanam, Pampa, Nilakkal and its surroundings clean and hygienic throughout the season, with the active participation and coordination of the pilgrims, and the activities of that project shall be supplemental to the work being done by the workers of Sabarimala Sanitation Society engaged by the District Collector, Pathanamthitta. 16. 16. In the order dated 04.10.2023, this Court noticed further that ‘Pavithram Sabarimala’ is another project launched by the 2 nd respondent Travancore Devaswom Board during Sabarimala festival season of 1198 ME (2022-23), vide Annexure R2(a) order dated 08.11.2022, which is a cleaning project by the employees of the Board at Sabarimala, Pampa, etc., for daily routine cleaning activities. By the order dated 04.10.2023, this Court directed the 5 th respondent Chief Police Coordinator and Additional Director General of Police (Law and Order) to conduct an enquiry into various aspects pointed out in that order and submit a preliminary report before this Court within a week. 17. An additional affidavit dated 25.10.2023 sworn to by the additional 8 th respondent was placed on record, producing therewith Ext.R8(f) brochure published as part of ‘Punyam Poonkavanam’ Project. 18. On 07.11.2023, the learned Senior Government Pleader submitted that the 5 th respondent requires some more time to complete the investigation in terms of the directions contained in the order dated 04.10.2023, since he is engaged in the investigation of a crime registered in connection with the Kalamassery Bomb Blast case. 19. In the order dated 07.11.2023, this Court noticed the submission made by the learned Senior Government Pleader, based on the affidavits dated 30.10.2023 filed by the additional 10 th respondent District Collector and the additional 11 th respondent State Police Chief, that the District Collector, Pathanamthitta has already evolved an action plan of Sabarimala Sanitation Society during Sabarimala Pilgrimage season of 1199 ME (2023-24), as stated in paragraph 9 of that affidavit. On account of the involvement of various private individuals and even publication and circulation of brochures citing the office address of ‘Punyam Poonkavanam’ project at Sannidhanam, the stand of the additional 11 th respondent State Police Chief is that, the activities during Mandala-Makaravilakku festival season of 1199ME (2023- 24) has to be carried out by the respective stakeholders in the State Government like District Administration, Travancore Devaswom Board, the Local Self-Government Department, Suchithwa Mission and the voluntary agencies under the control of such Departments. The Police will provide manpower to assist awareness activities at Sannidhanam, Pamba and Nilakkal, as and when required. 20. In the order dated 07.11.2023, having perused Ext.R8(f) brochure and considering the explanations offered by the additional 8 th respondent in the additional affidavit dated 25.10.2023, this Court found that, when ‘Punyam Poonkavanam’ Project was part of Police Bandobast Scheme, such a brochure should not have been printed and circulated among the pilgrims by third parties. In the said order, this Court noticed that, the contents of that brochure would give an indication that it is one printed and circulated by those who are part of Police Bandobast Scheme. Since Mandala-Makaravilakku festival season of 1199 ME (2023-24) will commence on 17.11.2023, this Court deemed it appropriate to defer consideration of those aspects for the time being. 21. On 20.11.2023 when this SSCR came up for consideration, regarding cleaning operations in Sabarimala Sannidhanam, the learned Senior Government Pleader submitted that the workers of Sabarimala Sanitisation Society have already been deployed for various activities at Sabarimala from 17.11.2023 onwards. The learned Standing Counsel for Travancore Devaswom Board submitted that, as stated in the affidavit dated 08.08.2023 filed on behalf of the 2 nd respondent Board, the activities of ‘Pavithram Sabarimala’ have also been commenced on 17.11.2023, with the active participation of the Devaswom employees and pilgrims. 22. On 30.01.2024, the learned Senior Government Pleader made available for the perusal of this Court an interim preliminary report dated 20.11.2023 of the 5 th respondent Chief Police Coordinator [Additional Director General of Police (Law and Order)], Sabarimala. After perusing the same, Registrar (Judicial) was directed to keep that interim preliminary report in a sealed cover. 23. On 11.04.2024, when this SSCR came up for consideration, the learned Standing Counsel for the Travancore Devaswom Board pointed out that under ‘Punyam Poonkavanam’ Project, one office room on the ground floor of the Darsan Complex with room No.4 is retained by Kerala Police. Another room in Pilgrim Centre-I with room No.401 is in the possession of additional respondents 8 and 9. One shop room on the ground floor of the Maramath Complex at Sannidhanam, used for ‘Punyam Poonkavanam’ Project, where the shop rooms are being auctioned, is lying vacant. The learned Senior Government Pleader submitted that room No.4 on the ground floor of Darsan Complex may be permitted to be retained by the Police, for the time being. One shop room on the ground floor of the Maramath Complex at Sannidhanam, used for ‘Punyam Poonkavanam’ Project, where the shop rooms are being auctioned, is lying vacant. The learned Senior Government Pleader submitted that room No.4 on the ground floor of Darsan Complex may be permitted to be retained by the Police, for the time being. The shop room on the ground floor of the Maramath Complex at Sannidhanam, used for ‘Punyam Poonkavanam Project, which is lying vacant, is not required for the Police. Room No.401 in Pilgrim Centre-I is in the possession of additional respondents 8 and 9. The learned counsel for additional respondents 8 and 9 submitted that in case room No.401 at Pilgrim Centre-I is under the possession of the said respondents, they shall surrender the key to the 4 th respondent Executive Officer, within two weeks. 24. By the order dated 11.04.2024, this Court directed the 4 th respondent Executive Officer to take vacant possession of shop room No.401 in Pilgrim Centre I, in case the key of that room is not surrendered within two weeks by additional respondents 8 and 9, by seeking the assistance of Station House Officer, Sannidhanam Police Station. Since the shop room on the ground floor of the Maramath Complex at Sannidhanam, used for ‘Punyam Poonkavanam’ Project, is not required for the Police, the 5 th respondent Chief Police Coordinator, Sabarimala, shall take necessary steps, through the officer concerned, to surrender vacant possession of that room to the 4 th respondent Executive Officer, within two weeks. The Police is permitted to retain room No.4 on the ground floor of Darsan Complex, for the time being, subject to the orders to be passed in this SSCR. 25. On 08.11.2024, when this SSCR came up for consideration, on a query made by this Court, the learned Standing Counsel for Travancore Devaswom Board submitted that in addition to the workers engaged through Sabarimala Sanitation Society, the workers of ‘Pavithram Sabarimala’ Project by the Board will also be deployed during Mandala-Makaravilakku festival season of 1200ME (2024-25), in order to ensure that the entire Sannidhanam and its surroundings are kept clean and hygienic throughout the season. The aforesaid submission made by the learned Standing Counsel was recorded in the order dated 08.11.2024. 26. On 21.02.2025, when this SSCR came up for consideration, the learned Senior Government Pleader made available for the perusal of this Court a report dated 23.01.2025 of the Additional Director General of Police (Armed Police Battalion Heard Quarters), who was formerly the Chief Police Coordinator, Sabarimala. Registry was directed to keep that report in safe custody by Registrar (Judicial). 27. Heard the learned Senior Government Pleader for respondents 1, 5 to 7 and additional respondents 10 and 11, the learned Standing Counsel for Travancore Devaswom Board for respondents 2 to 4 and the learned Senior Counsel for additional respondents 8 and 9. 28. As already noticed in the order of this Court dated 04.10.2023, ‘Punyam Poonkavanam’ Project is a community policing programme implemented in Sabarimala since 2011, during Mandala-Makaravilakku festival seasons, as part of the Police Bandobast Scheme, with an intention to keep Sannidhanam, Pampa, Nilakkal and its surroundings clean and hygienic throughout the season, with the active participation and coordination of the pilgrims, and the activities of that project shall be supplemental to the work being done by the workers of Sabarimala Sanitation Society engaged by the District Collector, Pathanamthitta. In the order dated 04.10.2023, this Court noticed that, as stated in the affidavit dated 22.07.2023 filed by the 5 th respondent Chief Police Coordinator, Sabarimala, ‘Punyam Poonkavanam’ Project was initiated in the year 2011 at Sabarimala, by the then Special Officer, Sabarimala. Subsequently, the project found a place in the Police Bandobast Scheme for the Sabarimala festival. In the order dated 07.11.2023, after perusing Ext.R8(f) brochure published as part of ‘Punyam Poonkavanam’ Project, which was placed on record along with an additional affidavit dated 25.10.2023 filed by the additional 8 th respondent, and considering the explanation offered by the additional 8 th respondent in that affidavit, this Court found that when ‘Punyam Poonkavanam’ Project was part of Police Bandobast Scheme, such a brochure should not have been printed and circulated among the pilgrims by third parties. In the said order, this Court noticed that the contents of that brochure would give an indication that it is one printed and circulated by those who are part of the Police Bandobast Scheme. 32. The conclusions in the enquiry report dated 23.01.2025 of the Additional Director General of Police (Armed Police Battalion Headquarters), who was formerly the Chief Police Coordinator, Sabarimala, are that the present activities of ‘Punyam Poonkavanam’ Project, which was initiated as a community policing initiative of the Kerala Police, are beyond the scope contoured by the Police Department. It was revealed during the enquiry that the Coordinators of ‘Punyam Poonkavanam’ Project had solicited and collected money and other articles from private individuals and organisations. Substantial amounts were spent on printing high quality booklets and brochures and for large scale advertisement campaigns. Serving and retired police officials involved in the programme travelled widely all over the country and it is suspected they have travelled in foreign countries as well. Since the programme is only a participatory community policing programme limited to Sabarimala and surrounding areas, without utilising any funds or sponsors, there is no provision to find out the flow of funds and articles to this programme from private individuals and hence it could not be verified or audited. The funding and sponsoring of articles are routed through private accounts. The enquiry revealed that, presently ‘Punyam Poonkavanam’ Project is run by private individuals of various States using the banner of Kerala Police and their activities are beyond the control of the Police Department and also the Government of Kerala. In the enquiry report, a recommendation has been made for a detailed enquiry to unearth the entire operations and financial transactions under ‘Punyam Poonkavanam’ Project. 33. The submission made by the learned Senior Government Pleader is that after the submission of the enquiry report dated 23.01.2025, the files in this SSCR, along with the said enquiry report, were placed before the learned Advocate General. As instructed by the learned Advocate General, the learned Senior Government Pleader would submit that the enquiry report dated 23.01.2025 will be considered by the Government and further action will be taken without any delay. 34. Since the enquiry report dated 23.01.2025 of the Additional Director General of Police (Armed Police Battalion Headquarters), who was formerly the Chief Police Coordinator, Sabarimala has to be considered by the State Government, we do not propose to consider in these proceedings the conclusions and recommendations made in the said enquiry report. 35. Having considered the pleadings and materials on record and also the submissions made at the Bar, we deem it appropriate to dispose of this SSCR by recording the stand taken by the additional 11 th respondent State Police Chief in the affidavit dated 30.10.2023 that on account of the involvement of various private individuals and even publication and circulation of brochures citing the office address of ‘Punyam Poonkavanam’ project at Sannidhanam, the activities to keep Sabarimala Sannidhanam, Pamba and its surroundings clean, from Mandala- Makaravilakku festival season of 1199ME (2023-24) onwards have to be carried out by the respective stakeholders in the State Government like District Administration, Travancore Devaswom Board, the Local Self-Government Department, Suchithwa Mission and the voluntary agencies under the control of such Departments, and the Police will provide manpower to assist awareness activities at Sannidhanam, Pamba and Nilakkal, as and when required; and also the stand taken by the Travancore Devaswom Board that from Mandala-Makaravilakku festival season of 1199ME (2023-24) onwards the activities to keep Sabarimala Sannidhanam, Pamba and its surroundings clean, from Mandala-Makaravilakku festival season of 1199ME (2023-24) onwards, are being carried out by the workers engaged by Sabarimala Sanitisation Society under the control of the additional 10 th respondent District Collector, Pathanamthitta and through ‘Pavithram Sabarimala’ launched by the Board during Mandala-Makaravilakku festival season of 1198ME (2022-23), a project with the participation of the employees of the Board. 36. The Travancore Devaswom Board and also Kerala Police shall issue advisory to Sabarimala pilgrims that ‘Punyam Poonkavanam’ Project, which was a community policing programme of Kerala Police in Sabarimala, is not part of Police Bandobast Scheme from Mandala-Makaravilakku festival season of 1199ME (2023-24) onwards and that the name of the said project cannot be used for any activity connected with Sabarimala. The 1 st respondent State shall take further action based on the enquiry report dated 23.01.2025 of the Additional Director General of Police (Armed Police Battalion Headquarters), who was formerly the Chief Police Coordinator, Sabarimala, as expeditiously as possible.
