ORDER : (YOGENDRA KUMAR PUROHIT, J.) 1. Service is complete. 2. The instant appeals have been filed under Section 14A(2) SC/ST (Prevention of Atrocity) Act 1989 on behalf of the appellants, who are in custody in connection with FIR No. 475/2024 registered at Police Station Sangriya, District Hanumangarh for the offences under Sections 109(1), 333, 324(2), 61(2) of BNS and Section 27 of Arms Act and 3(2) (va) of SC/ST (Prevention of Atrocity) Act. 3. Learned counsel for the appellants submits that the appellants have been falsely implicated in the case. Challan has been presented. He further submits that in investigation it is found that the firing has been done by the Kuldeep and recovery was also made from him only. In cross-case, the fire injuries are found to be caused to accused-appellants party. Learned counsel submits that appellants are behind the bars and trial may take long time to conclude thus, they deserves to be enlarged on bail. 4. Per contra, learned Public Prosecutor and learned counsel for the appellants opposed the bail applications. 5. Perused challan papers. Having regard to the totality of facts and circumstances as available on record and upon a consideration of the arguments advanced, I am of the opinion that the appellants deserves to be enlarged on bail. 6. Consequently, the instant appeals are allowed. The impugned order dated 01.10.2024 passed by Learned Special Judge, SC/ST (Prevention of Atrocities) Act Cases, Hanumangarh is set aside. It is ordered that the accused-appellants - Rohit @ Rubi S/o Shiv Prakash, Gurprit Singh S/o Svarn Singh, Ramesh Verma @ Golu S/o Gopal Verma and Jitendra Kumar @ Jeetu S/o Hari Singh arrested in connection with aforesaid FIR , shall be released on bail, if not wanted in any other case, provided they furnish a personal bond of Rs. 1.00,000/- and two sureties of Rs. 50,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
