JUDGMENT : This writ petition is filed under Article 226 of the Constitution of India for the following relief/s : "...to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent authorities more particularly the respondent No.2 in not releasing the annual grade increments of the petitioner since 01.09.2019 to till date despite my regularization of service vide GORT No.60 dated 04.02.2024 as arbitrary, illegal, void, against the principles of natural justice, against the service rules in vogue and violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the 2nd respondent to release the annual grade increments of the petitioner since 01.09.2019 to till date and pass such other order or orders...." 2. Heard Sri Anguru Manohar, learned Counsel for the petitioner and learned Assistant Government Pleader for Services-II for respondents. 3. Petitioner was initially appointed as Assistant Executive Engineer in Roads and Buildings Department on 24.02.1992, later promoted as Deputy Executive Engineer and posted in Andhra Pradesh Bhavan, Sub-Division, New Delhi, from 14.06.2023 to 08.01.2024. Before being posted there, petitioner was on deputation to National Highways Authority of India (NHAI) as Deputy General Manager (Technical). On completion of deputation, he was repatriated to his parent department by an order dated 28.02.2018. Challenging the said repatriation order, the petitioner filed OA No.194 of 2018 before the Central Administrative Tribunal. Subsequently, by another order dated 18.06.2019, the petitioner was once again repatriated to parent department, on completion of extended period of deputation, which also came to be challenged before the Tribunal. On dismissal of the said O.A., the petitioner has reported at Andhra Pradesh Bhavan, Sub-Division, New Delhi, as Deputy Executive Engineer. Thereafter, he was placed under suspension by proceedings dated 02.01.2024 and pending disciplinary proceedings, he filed WP No.15428 of 2024, in which, this Court has directed the respondents to reinstate the petitioner into service. The Government regularized the period on deputation, beyond sanctioned period from 21.06.2019 to 25.01.2021, by G.O. Rt. No.60 dated 04.02.2024. The petitioner thereafter made a representation dated 29.10.2024, claiming annual grade increments since 01.09.2019 onwards, which is pending consideration with 2nd respondent. 4. Learned Counsel for the petitioner submits that as the 2nd respondent has not disposed of his representation, it would suffice to direct for disposal of the said representation. 5.
No.60 dated 04.02.2024. The petitioner thereafter made a representation dated 29.10.2024, claiming annual grade increments since 01.09.2019 onwards, which is pending consideration with 2nd respondent. 4. Learned Counsel for the petitioner submits that as the 2nd respondent has not disposed of his representation, it would suffice to direct for disposal of the said representation. 5. Learned Assistant Government Pleader submits that they would consider the representation, in accordance with law, if some time frame be specified by this Court. 6. In view of the submissions made above, without expressing any opinion on the merit of the matter, the writ petition is disposed of, directing the 2nd respondent to consider the representation dated 29.10.2024 submitted by the petitioner claiming the annual grade increments, in accordance law, within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 7. As a sequel, miscellaneous petitions, pending if any, shall stand closed.
