ORDER : ARUN MONGA, J. 1. On a Court query, learned counsel for the petitioner, at the very outset, concedes that merely because petitioner has been transferred from Kotputli to Barmer, may not necessarily confer Principal Bench at Jodhpur of this Court with the territorial jurisdiction entertain the instant petiton. However, he submits that there are other multiple reasons giving rise to the part cause of action, so as to invoke the jurisdiction of Principle Bench. 2. The matter needs consideration. 3. Issue notice. 4. Learned counsel Mr. Tanuj Jain appearing for Mr. Mukesh Dave, A.G.C., accepts notice on behalf of the respondents. The service is thus, dispensed with. 5. Reply is already on record. Rejoinder, if any, be filed. 6. The respondents are at liberty to file additional affidavit, if any. 6. Post it on 03.03.2025. 7. Meanwhile, it transpires that wife of the petitioner is in advance stage of second trimester of her pregnancy. She has had the misfortune of having had to medically terminate her earlier two pregnancies. Given the hardships, which the petitioner and his wife shall have to suffer by virtue of relocation, in case the transfer order is implemented, the respondents are directed to put on hold the impugned transfer order of the petitioner till next date of hearing. 8. Furthermore, my attention has been drawn to para No.12 of the petition wherein it is stated that there is only one post of ECG Technician on which the predecessor of the petitioner is already working, as he has not been transferred. Thus, the counsel would contend that there is no administrative exigency which warrants petitioner’s transfer. 9. Also, it transpires that no successor has joined on the post which was being earlier manned by the petitioner. In the larger public interest especially the patients come for check-up in the hospital where petitioner is posted, he shall be allowed to join back on his duty upon approaching the respondents with the web-print of the instant order.
