ORDER : SUREPALLI NANDA, J. Heard Sri B.H.R.Choudary, learned counsel appearing on behalf of the petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development appearing on behalf of the respondent Nos.1 to 7, Sri Jagan Mohan Perumandla, learned counsel appearing on behalf of the respondent No.8. 2. The petitioner approached this Court seeking the prayer as under: “….to issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the inaction and negligence of Respondents 1 to 7 in considering the complaint and grievance by the respondents 1 to 7, that respondent No.8 has appropriated all the benefits granted for the killing of their father in extremist violence, while he was in harness in Government Service is violative of Articles 14,16 and 21 of the constitution of India and also the Government circular memo No.58226/Ser-A/2000-2, GAD(Service-A) Department dated: 01-05-2001 consequently. a) Direct the respondents 1 to 7 to take appropriate action as per Government circular Memo No. 58226/Ser.A/2000-2, GAD(Ser.A) Dept, dt: 01-05-2001 against Respondent No. 8. b) Direct the respondents 1 to 7 to initiate enquiry into the charge of forgery of the signatures of the petitioner and deceased Mothemma and also to take appropriate action against respondent No.8 and pass such order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.” 3. The limited relief as prayed for by the petitioner in the present writ petition is a direction to Respondent Nos. 6 and 7 to consider and pass appropriate orders on the petitioner's representation dated 03.01.2017, which was registered as Petition No. WGUDC/E/2017/00354 on the file of Respondent No. 6 pertaining to providing suitable employment to the petitioner based on his qualifications, granting compensation for the loss and damages suffered by him, and to award monetary compensation to petitioner’s two daughters under the Girls Protection Scheme, on the ground that petitioner’s father was attacked on 23.10.1996 by naxalites. 4. It is further the case of the petitioner that, although the petitioner reminded Respondent Nos.6 and 7 through a legal notice dated 08.08.2018 issued on behalf of the petitioner, no action has been taken as on date on petitioner’s representation dated 03.01.2017, which was registered as Petition No.WGUDC/E/2017/00354 on the file of Respondent No. 6. Aggrieved by the inaction of the respondent Nos.6 and 7, the petitioner has filed the present writ petition. The learned Assistant Government Pleader for Panchayat Raj and Rural Development appearing on behalf of Respondent Nos.1 to 7, submits that the writ petition may be disposed of directing Respondent Nos.6 and 7 to consider the grievance of the petitioner, as put- forth vide petitioner’s representation dated 03.01.2017, w hich had been registered on the file of Respondent No. 6, and the respondent Nos.6 & 7 may further be directed to take appropriate action in accordance to law within a reasonable period, upon the said representation of the petitioner, dated 03.01.2017. 6. Learned counsel appearing on behalf of the petitioner and respondent No.8 does not dispute the said submission made by the learned Assistant Government Pleader for Panchayat Raj and Rural Development, appearing on behalf of Respondent Nos.1 to 7. 7. TAKING INTO CONSIDERATION: a) The aforesaid facts and circumstances of the case, b) The submissions made by the learned counsel appearing on behalf of the petitioner and the learned Assistant Government Pleader for Panchayat Raj and Rural Development appearing on behalf of the respondent Nos.1 to 7 and the learned counsel appearing on behalf of the respondent No.8, c) The contents of the representation of the petitioner dated 03.01.2017 registered on the file of the respondent No.6 d) The fact that the said application dated 03.01.2017 admittedly had not been disposed of by the respondent No.6 as on date e) The contents of the petitioner’s legal notice dated 08.08.2018, The writ petition is disposed of directing the respondent Nos.6 and 7 to consider the representation of the petitioner dated 03.01.2017 which is registered as Petition No. WGUDC/E/2017/00354 on the file of the respondent No.6 and pass appropriate orders on the said application seeking suitable employment based on petitioner’s qualification, compensation amounts for the loss and damages suffered by the petitioner and the family, and other benefits in accordance to law , within a period of four (4) weeks from the date of receipt of a copy of this order duly considering the legal notice dated 08.08.2018 issued on behalf of the petitioner and communicate the decision to the petitioner herein. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed.
