JUDGMENT : ANANDA SEN, J. By filing this writ application, the petitioners have prayed for the following relief: - For issuance of appropriate writ(s)/order(s)/direction(s) in the nature of mandamus commanding upon the respondent-Jharkhand Staff Selection Commission (in short J.S.S.C.) to re-conduct the examination for the petitioners of subject-Language-HO (for Class-I to V) pursuant to Advertisement No.13 of 2023 (Jharkhand Trained Primary Teacher Joint Examination, 2023), since the examination, which was held on 15.06.2024 through Computer Based Test (C.B.T.) Mode about 75% of the questions have been asked outside the syllabus not from the syllabus contained in Annexure-XII of the advertisement, which was prescribed for Class-I to V, rather the questions were asked from the syllabus as contained in Annexure-XIII of the advertisement prescribed for Class-VI to VIII. 2. It is the case of the petitioners that the questions of “HO” subjects were beyond the syllabus. 3. It is the case of the petitioners that similar situation arose in respect of Kurmali language and Panchpargania language. Some of the candidates of those who opted for those languages namely Kurmali and Panchpargania approach this Court by filing writ application being W.P.(C) Nos. 4476 of 2024 & 4589 of 2024. 4. The Co-ordinate Bench of this Hon’ble Court disposed of the representation with a direction to the respondent no.5 to consider the writ petition as a representation and further directed to make an enquiry by constituting an expert committee and pass a reasoned order after affording opportunity to one of the representatives of the petitioners and it was further held that if the grievance of the petitioners is found to be genuine, necessary order be passed. Four weeks’ time was granted to complete the entire exercise. Once the representation was filed in respect of language Panchpargania and Kurmali, the respondents came out with a notification no. 656 dated 22.01.2025 and the papers of Panchpargania and Kurmali have been cancelled. 5. Similar is the situation here in respect of language “HO”. It is the case of the petitioners that the questions were out of syllabus. 6. Since, the issue in this writ petition is similar, to that of the writ petitioners in W.P.(S) Nos. 4476 of 2024 & 4589 of 2024, I direct the respondent no. 5 to treat this writ petition as a representation and proceed accordingly.
