JUDGMENT : 1. Issue notice to the respondents. 2. Mrs. Darshana Poddar Mishra, AAG-I accepts notice on behalf of the respondents. 3. Prima facie, the impugned order dated 22.06.2024 in all cases passed by the respondent no. 3 treating the work given to the petitioner by Bharat Coking Coal Limited as a “support service to mining”, appears to be perverse and without jurisdiction since the work order specifically mentions that the work awarded to the petitioner is of “transportation of coal from different sources to different destinations” though it includes activity of crushing of coal by a hired mobile crusher. Therefore, there shall be an interim stay to all further proceedings pursuant to Annexure-1 dated 22.06.2024 in all cases passed by the respondent no. 3, until further orders. 4. List these cases on 18.06.2025. 5. In the meantime, counter affidavit be filed.
