VINIT KUMAR MATHUR

body2025
ORDER : VINIT KUMAR MATHUR, J. Heard learned counsel for the petitioners. 2. Learned counsel for the petitioners submits that the petitioners have filed an appeal before the Divisional Commissioner, Pali against the order dated 24.07.2024 passed by the Sub-Divisional Officer, Pindwara, District Sirohi. He further submits that the appeal filed by the petitioners was pursued by them before the Divisional Commissioner, Pali and while the proceedings of appeal were pending, the Office of Divisional Commissioner, Pali was dissolved/discontinued and the jurisdiction of the same is now vested with the Divisional Commissioner, Jodhpur. Learned counsel further submits that the proceedings of appeal preferred by the petitioners will now be undertaken by the Divisional Commissioner, Jodhpur. He further submits that the record of appeal preferred by the petitioners is in process to be shifted from Pali to Jodhpur and the next date in the case has been given as 19.03.2025. 3. Learned counsel submits that if in the interregnum period, the Tehsildar Revenue Records, Pindwara change the revenue entries and if, the interim protection is not provided to the petitioners then the very purpose of filing the appeal by the petitioners before the Divisional Commissioner shall be frustrated. 4. Considering the limited prayer made by the counsel for the petitioners, the present writ petition is disposed of with a direction to the Tehsildar Revenues Records, Pindwara, not to change the revenue entries till 19.03.2025. 5. Needless to say that the petitioners shall prosecute their pending appeal before the Divisional Commissioner, Jodhpur from 19.03.2025 onwards for further orders in that respect.
