ORDER : 1. Leave granted. 2. The appellant was convicted by the trial magistrate for commission of offence punishable under Section 138 of the Negotiable Instruments Act, 18811, vide judgment dated 4th March 2020. He was sentenced, on the same day, to two years rigorous imprisonment or to pay a fine one and a half times the cheque amount of Rs.5,00,000/-, i.e., Rs. 7,50,000/-. 3. The judgment of conviction and order on sentence was carried by the appellant in appeal before the sessions court, which dismissed the appeal on 7th December, 2021. A revision filed before the High Court also proved to be unsuccessful. 4. The revisional judgment dated 4th April, 2023 is under challenge. On the special leave petition, giving rise to this appeal, a coordinate Bench recorded on 30th May 2023 that no case calling for interference on merits was found. However, bail was granted to the appellant on condition of depositing Rs. 6,50,000/- with the Registry of this Court which was directed to be invested in an interest bearing fixed deposit account. 5. It is not in dispute that not only has Rs. 6,50,000/- been deposited in this Court by the appellant, but he previously deposited Rs. 1,00,000/- before the Court of the 16th Additional Chief Judicial Magistrate, Vaishali at Hajipur, Bihar. 6. The complainant/respondent no.2, represented by learned counsel, has no objection to compounding of the offence committed by the appellant provided the amount deposited by him, i.e., Rs. 1,00,000/- plus Rs. 6,50,000/-, totaling to Rs. 7,50,000/- is made over to him together with accrued interest, if any. 7. Having regard to the aforesaid submission of the complainant/respondent no.2 and considering that the fine amount has been deposited by the appellant in full, coupled with the statutory ordainment that Section 147 of the N.I. Act makes every offence thereunder compoundable, we direct compounding of the offence which the appellant was found to have committed. The amount of Rs. 7,50,000/-together with accrued interest shall be made over to the complainant/respondent no.2 by the Registry of this Court as well as the Registry of the Court at Vaishali, Hajipur, Bihar, in accordance with the law, within 4 weeks of an approach made in this behalf with a certified copy of this order. 8. In the result, the conviction and sentence stand set aside and the appeal stands allowed. The appellant is discharged of the bail bond. 9.
