ORDER : Heard Ms. Jacinta Zothanmawii, learned counsel for the petitioners who submits that despite completion of the works allotted to the petitioner namely, (i) Infrastructure for 107 Govt. School Buildings under NABARD-RIDF XXV (2019-2020) in all respect on 28th October, 2022 and (ii) Reconstruction of 53 Govt. School Buildings and construction of 12 Additional Classrooms/Science laboratories in Mizoram under NABARD-RIDF XXIV (2018-2019) in all respect on 28th November, 2022, the respondent authorities have not released the Security Deposit amounting to Rs. 25,00,000.33/- and Rs. 62,49,892.97 respectively deposited for the aforesaid works. Aggrieved, the petitioner is before this Court. [2.] The learned counsel on being asked as to whether the petitioner has approached the respondent authorities for release of the security deposit submits that although the petitioner has approached the authorities verbally but the verbal request has not been acceded to by the respondents. It is however seen that the petitioner nowhere made any statement that he has approached the respondents and that he submitted a demand notice/representation for release of the Security Deposit. [3.] Such being the position, the writ petition is being disposed of by giving liberty to the petitioner to approach the respondent authorities concerned for release of the aforesaid Security Deposit in writing. In the event such amount is not released to the petitioner, the petitioner will be at liberty to approach this Court again.
