ORDER 1. In pursuance to the letter addressed to the Registrar General dated 4.9.2025 as per directions issued by the Division Bench of this Court in the case of In reference (suo moto) v. State of M.P. : Writ Petition No. 5184 of 2025 decided on 20.2.2025, cognizance was taken and the letter was treated as suo moto petition. Accordingly, this writ petition came up for consideration before this Court. 2. The facts of the case, in substance, are that the prosecutrix being minor aged around 17 years and 10 months is reportedly the victim of exual assault. It is alleged that she was sexually assaulted and raped by accused, upon which, an FIR as Crime No. 193 of 2025 at Police Station Badi, District Raisen (MP) for the offences under sections 137(2), 87, 64 (2) (g), 64 (2) (m) of the BNS,2023 and sections 5(L)/6, 5 (q)/6 of the POCSO Act, 2012 has been registered. During medical examination, the victim was found to be pregnant. 3. This Court vide order dated 17.9.2025 observed as under : "The Authorities along with a lady Judicial Officer as well as a team of Doctors and a member from CWC are also directed to hold a mediation/counselling of the parents of the victim as well as the victim on the particular aspect that what are the pros & cons if the baby is born alive as the fetus is of 34 weeks. They should also ensure the counseling to the effect that in case they do not want to keep the baby, then can the pregnancy be taken to its full and thereafter, after delivering the child, the responsibility will entirely be of State Government to take care of the child in the event they do not want to keep the child. The counseling to be done on both aspects and the report be furnished by the State authorities positively by tomorrow i.e. on 18.09.2025." 4. From the perusal of the report, it is seen that the same is duly signed by the Counselling Team consisting of 5 members including the officers from Child Welfare Committee (C.W.C.) Raisen. It is clear therefrom that the victim and her parents have not given the consent for termination of pregnancy and they want to continue the pregnancy looking to the gestational period of 8 months and the victim wants to deliver the child. The parents of the victim as well as the victim herself have clearly stated in their statements that they do not want to keep the child with them and after delivery of the child, if born alive, they will handover the child to CWC, Raisen. Further, information has been given to the victim as well as her parents regarding the schemes floated by the Government in this regard. 6. In view of the report on counselling as well as the willingness of the victim and her parents to deliver the child, this Court deems it appropriate to dispose of this writ petition, based upon the consent and willingness shown by the victim as well as her parents, by directing the authorities of the C.W.C. Raisen that for a period of 15 days from the date of birth of the child, if born alive, for the purpose of breast-feeding, they will permit the child to stay with the victim/mother and after 15 days from the date of his/ her birth, they will take the custody of the child and take every care for upbringing the child. The C.W.C. Raisen will be at liberty to give the child on adoption to any willing family in accordance with law. 7. The State authorities are directed to ensure the privacy of the victim and any information including family details should not be published in any form of media which could lead to the identification of the victim. The said directions are being issued looking to the welfare of the child so that his/her upbringing can be taken care of. 8. In above terms, the petition stands disposed of finally. 9. The report be kept in the file.
