ORDER : 1. This Writ Petition is filed by way of House Motion under Article 226 of Constitution of India praying to issue Writ of Mandamus to declare the impugned rejection orders passed by respondent No.4 and basing on the alleged rejection orders of respondent No.4 issuing the present impugned letter dated 20.05.2025 by respondent No.5 as illegal and further prayed this Court to set aside the impugned order dated 20.05.2025 issued by respondent No.5 and prayed to direct respondent No.5 to accord permission to conduct world peace festival scheduled to be held on 24.05.2025 in Gymkhana Grounds, Secunderabad for support the world peace festival and further requested to suspend the impugned letter dated 20.05.2025 of respondent No.5 directing the respondent No.4 to accord permission. 2. The main grievance of the petitioner is that the petitioner-Gospel (unreached Millions Society), represented by its Executive Member is working for the entire World to upgrade the lifestyle of the unreached poor people with the activities in the entire World, headed by Dr. K.A. Paul and they are running the activities in the entire world and whenever the Countries in the several places in the entire World nearer to the War, the petitioner was working to setback those wars. Besides that the petitioner is intending to perform meeting on occasion of ‘stopped war’ between India and Pakistan to enlighten the people for peace and to avoid the wars in World, where Dr. K.A. Paul doing the same since long decades. It is also further stated that the petitioner has applied for permission on 15.05.2025 to Respondent No.4 in respect of conducting a ‘Global Peace Festival’ on 24.05.2025, wherein they are inviting 2000 people and leaders. 3. It is also further submitted that the CEO of Gymkhana Grounds has also granted permission for conducting the Global Peace Festival to respondent No.4 after paying prescribed fee. Further, the petitioner has received the letter dated 20.05.2025 from respondent No.5 who gave permission for utilizing Gymkhana Ground for conducting the said Global Peace Prayer and they have found that permission was not accorded by respondent No.4 as such they intimated to get permission from the police and other departments as the meeting is going to be held on 24.05.2025. 4. 4. Having aggrieved by the same, the present writ petition is filed contending that the petitioner has conducted similar meeting earlier in the year 2022 on the eve of the Gandhi Jayanthi and earlier also respondent No.4 has rejected the said application on various grounds. The present application of the petitioner was rejected by the respondent No.4 on the following reasons. “1. The proposed date for this event is 24-05-2025 (Saturday) which is a working day. This period will witness peak vehicular traffic movement on the city roads; The above venue is located near main road towards Panjagutta and Secunderabad Road. 2. In the absence of clearly specified numbers of participants, it will be extremely difficult for the Police to plan and implement adequate Band-o bust. Moreover, a sudden increase in the crowd will also make it challenging for the police to restrict them and there will always be possibility of the crowd suddenly rush towards main road; it will cause obstruction to the free flow of Traffic. 3. The organizer has not specified the route/routes through which the participants will be mobilized. In the absence of clearly mentioned route/routes, the traffic wing will find it extremely difficult to regulate the crowds coming for this event, besides ensuring smooth regular traffic flow. 4. Permission to conduct "Global Peace prayer meeting" at aforementioned venue cannot be granted, as it may throw public life out of gear and cause enormous inconvenience to road users, employees and particularly sick people who require urgent medical assistance. 5. The using of loud speaker with audible sound, create disturbance to local residences Balamrai, Anna Nagar, Rasoolpura and they may complain. 6. There is no sufficient parking place at Venue Proposed area for expected gathering of public. 7. The organizer of this event has not indicated the specific number of participants. The proposed venue has a very limited crowd holding capacity. It has been experienced that the number of participants invariably becomes much higher. Hence, there is possibility of large number of people gathering beyond the capacity of proposed venue which would cause nuisance, disturbance to public peace and inconvenience to local public and also traffic congestion around all the roads surrounding. 8. It will cause huge traffic congestion in and around the venue proposed. 9. Paul has made derogatory comments and provocative statements against some political leaders, due to which some political party members may protest in the meeting create nuisance and public tranquility. 10. The permission for the said "Global Peace prayer meeting" cannot be given in view of the prevailing security scenario, as there is likelihood of disturbance to the Public Peace and Law & Order.” 5. Being aggrieved by the same, the present writ petition is filed by way of House Motion. 6. Having heard Sri Brahmadandi Ramesh, learned senior counsel representing Sri G.L. Narsimha Rao, learned counsel for the petitioner appeared virtually and Sri Mahesh Raje, learned Government Pleader for Home appeared physically for respondent Nos.1 to 4 and Sri K.R. Koteshwar Rao, learned Standing Counsel appeared virtually for respondent No.5. 7. The main grievance of the petitioner is that petitioner is intending to conduct a Global Peace Prayer, headed by Dr.K.A.Paul on 24.05.2025 from 5 to 10 P.M. in Gymkana grounds and they are inviting 2000 spiritual people for the prayers. It is also contended that the petitioner has also applied for permission to respondent No.5 who vide letter dated 20.05.2025 granted permission, but it is stated that by the time they granted it is brought to the notice that Police Department has denied the permission for conducting Global Peace Festival at Gymkhana Grounds and subsequently, the petitioner was served with the letter of permission granted on 14.05.2025, subsequently on 20.05.2025 another letter was issued by respondent No.5 to petitioner stating that since the Police Department denied the permission for conducting the peace festival on 24.05.2025, directed the petitioner to conduct the said festival only after obtaining permissions from Police Department and other concerned departments as required, failing which allotment of ground for conducting the Peace Festival may be treated as cancelled. 8. The petitioner contends that the proceedings issued by of the Assistant Commissioner of Police law and order Northern Zone, Hyderabad, dated 21.05.2025 wherein the permission for the said Global Peace Prayer was rejected, has not been served upon the petitioner. 9. 8. Learned Senior Counsel appearing for the petitioner has submitted that the said meeting was conducted earlier in the similar places and even today, the petitioner is intending to conduct the same only for the purpose of conducting peace festival scheduled to be held on 24.05.2025. 10. Learned Government Pleader for Home submitted that the main reasons for rejection of the said meeting by the police is that as 24.05.2025 is a working day and it would be extremely difficult for the police for Bandobasth making it a challenge for the police to restrict them as there will be a lot of inconvenience to the general public and there would be huge traffic and disturbance in respect of using of loud speakers and also it may affect the public life. 11. Considering the submissions of learned Government Pleader for Home that recently Dr.K.A.Paul has made derogatory comments and provocative statements against some political leaders, due to which some political party members may protest in the meeting, which create nuisance and public tranquility. 12. Learned counsel for the petitioner also contended that they are ready to abide by any conditions passed by this Court and that only less than 1000 people would be attending the meeting and they would arrange some volunteers to manage the entire inflow and outflow of vehicles. He further contended that it is only to express their support in view of prevailing disturbances in the Country, he also contended that there will be no speeches against the political parties. 13. Though, learned counsel for respondents has opposed that there are organizers, who are also opposing the meeting to be conducted, which may lead to some law and order situation and he also produced the letters and representations made by certain Bharat Christian Council which was given to the Deputy Commissioner of Police/respondent No.4 on 20.05.2025, learned Government Pleader for Home has also pointed out referring to certain postings posted in the Social Media, wherein Dr. K.A.Paul said to have made some submissions against the present Hon’ble Chief Minister of Telangana, the Hon’ble Chief Minister of Andhra Pradesh and the Hon’ble Prime Minister; that in view of the same the police have apprehended that there will be law and order problem. 14. On perusal of the entire rejection letter of the Commissioner of Police, it shows that except conditions 9 and 10, the reasons cited appear to be in respect of Bandhobasth, traffic congestion and parking. 15. At this stage, learned Senior Counsel for the petitioner has submitted that they have sufficient space in the said ground for the purpose of parking and that if permission is granted the petitioner is ready to change the timings i.e., from 7:00 P.M to 9:00 P.M. 16 . Considering the submissions of both the learned counsel, this Court is of the opinion that as it is seen that earlier the similar prayer meeting was also conducted in the same place in the year 2022 at and as of now it is not the case of the respondents is that in the similar meeting, there was no such disturbance occurred as stated by the learned Government Pleader for Home, and permission may be granted by imposing certain conditions, as the present application is filed seeking permission for conducting the said meeting in respect of the conditions laid in condition Nos. 8, 9 and 10, this Court opinions that the petitioner shall not give any speeches during the meeting, except doing prayers. 17. Accordingly, the Writ Petition is allowed by setting aside the impugned letter dated 20.05.2025 and the proceedings, dated 21.05.2025. Respondent Nos.1 to 5 are directed to permit the petitioner to conduct Global Peace Festival scheduled to be held on 24.05.2025 subject to the following conditions: (i) Petitioner-society shall conduct prayer meeting with not more than 1000 people and they are permitted to use four (4) mikes (3 pins) with 45 decibels and they shall not use any DJ or any such other sound equipment which causes noise disturbance to the people in the vicinity. (ii) No person on the dias or off the dias shall give any speech except conducting prayers. (iii) The respondents shall provide necessary bandhobasth to the petitioner for conducting the aforesaid meeting peacefully on payment of usual charges. (iv) The said meeting shall be conducted on 24.05.2025 in between 7:00 PM to 9:00 PM and the entire programme shall be closed by 9:00 PM sharp. (v) Petitioner-society shall furnish an undertaking in respect of steps, which they are going to take as to entire plan of the programme, rough sketch of the entire ground, total number of participants to respondent No.4. (vi) Petitioner-society shall also furnish an undertaking to respondent No.4 stating that they will be responsible and will be liable for any untoward incident if any, occurred in such meeting. (vii) None of the participants or the organizers shall give any slogans or do any such act which is against to the interest and integrity of the Country. (viii) The respondent-police are at liberty to take appropriate action in the event of violation of aforesaid conditions. Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
