body2025
ORDER : 1. Heard Shri D.R. Ravishankar, learned Senior Counsel for Shri H.K. Srivasthava, learned counsel appearing for the petitioners; Shri S. Basavaraj, learned Senior Counsel for Shri Cyril Prasad Pais, learned counsel appearing for respondent No.1. 2. The issue lies in a narrow compass. It transpires that the co-ordinate bench, while disposing the petition, concerning the parties, directed disposal of the application without granting unnecessary adjournments. Notwithstanding on an allegation that the presiding officer has granted adjournments at the request of the plaintiffs. The defendants file an application before the concerned Court seeking transfer of the petition to any other Court, as it was acknowledged violation of the order passed by the co-ordinate bench. The said application comes to be rejected. It is therefore the petitioners are before this Court. 3. The learned Senior counsel appearing for the parties would submit that if a direction is issued to the concerned Court to dispose the applications as was directed by the co-ordinate bench within 15 days from tomorrow, tomorrow being the date of next listing, it would suffice. 4. In the light of the consensus arrived at between the learned Senior counsels for the disposal of the petition, within 15 days as also noticing the breach of the order passed by the coordinate bench which had directed disposal of the petition, I deem it appropriate to direct the concerned Court to comply with the orders, within an outer limit of a fortnight from tomorrow. 5. It is made clear that the order shall be adhered to it stricto sensu. 6. With the aforesaid observations, the petition stands disposed.
