ORDER Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. The accused/petitioner seeks bail in connection with Sangrampur P.S. Case No.69 of 2021 registered for the offence punishable under Section 302 read with 34 of the Indian Penal Code (in short ‘IPC’). 3. The accused/petitioner is is named in the FIR and is in custody since 25.03.2025. 4. As per FIR, the petitioner along with other coaccused persons assaulted the father of the informant on 20.03.2021 at about 1:30 P.M. causing severe head and bodily injuries, where during course of treatment, the father of informant succumbed to his injuries. 5. It is submitted by learned counsel appearing for the petitioner that petitioner has been implicated with this case only for the reason that she is the wife of main coaccused Lalan Ram, who after facing the trial already acquitted by learned trial court through judgment dated 1st December, 2022 as passed in S.T. No.24 of 2022, by the court of learned Additional Sessions Judge-19th, Motihari. It is pointed out that the allegation against the petitioner is appearing very much general and omnibus and moreover investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence. It is pointed out that petitioner is a lady of clean antecedent and she is languishing in jail with her eight months old baby. 6. Learned APP appearing for the State could not disputed the aforesaid submissions as advanced by learned counsel appearing for the petitioner. 7.

In view of aforesaid factual submissions and by taking note of fact as prima facie implication of this petitioner appears being the wife of main co-accused Lalan Ram, who already appears acquitted after facing trial, coupled with the fact that investigation of this case is already completed, where petitioner is a lady of clean antecedent and she remains in custody since 25.03.2025, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, East Champaran at Motihari in connection with Sangrampur P.S. Case No.69 of 2021, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short ‘CrPC’)/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short ‘BNSS’).
