Judgment : B.V.L.N. CHAKRAVARTHI, J. Sri A.V. Sivaiah, learned counsel for the appellants would fairly concede that the Second Appeal is not maintainable, if at all CMA could have preferred. In that view of the matter, the Appeal may be disposed of with a direction to the trial Court to proceed with the matter, as per the remand order made by the learned First Appellate Court. 2. Sri A.S.C.Bose, learned counsel for the respondents reported no objection. 3. Upon hearing the learned counsel on both sides and in the light of foregoing submissions, this Court deems it appropriate to dispose of the Second Appeal with a direction to the trial Court to proceed with the matter, as per the direction made in the remand order by the learned First Appellate Court. 4. As the suit is of the year 1990, the learned trial Court is directed to proceed with the matter as expeditiously as possible, preferably within a period of six (06) months from the date of receipt of copy of this order. 5. With the above directions, the Second Appeal is disposed of. No order as to costs. 6. Registry is forthwith directed to dispatch the trial record. Interlocutory applications, if any, pending shall stand closed.
