JUDGMENT : (Rajesh Shankar, J.) The present writ petition has been filed for issuance of direction upon the respondent-CCL to immediately grant adequate amount of compensation along with interest to the petitioner no. 1 in lieu of acquisition of her ancestral land by the respondent-CCL appertaining to Khata Nos. 01, 04 & 05, Plot Nos. 50, 53, 81, 142(P), 143, 23, 27, 40, 41, 140, Halka No. 06, Thana No. 84, Mouza-Sidalu, Circle-Tandwa, measuring an area of 07 acres, belonging to her grandfather namely, Late Meghan Ganjhu. Further prayer has been made for issuance of direction upon the respondent-CCL to immediately grant employment along with all other consequential benefits to the petitioner no. 2 (as already been provided to the respondent nos. 11 to 13) in lieu of acquisition of his aforesaid ancestral land by the respondent-CCL. 2. Learned counsel for the petitioners submits that the petitioner no. 1 being the daughter of Late Batura Ganjhu had the lawful right over the land in question, however, on the basis of false genealogy issued by the respondent no. 3 – the Circle Officer, Tandwa, Chatra (Annexure-1 to the writ petition), wherein Batura Ganjhu had been shown issueless, the employment in lieu of acquisition of the land in question was fraudulently obtained by the respondent nos. 11 and 12. An enquiry was also initiated by the concerned Area of the respondent-CCL, however, the same could not be concluded as would be evident from letter dated 26.06.2024 issued under the signature of the respondent no. 10 – the Staff Officer (Land & Revenue), Piparwar Arear, Central Coalfields Limited, Piparwar, Chatra under the Right to Information Act, 2005. Under the said compelling circumstance, the petitioners have preferred the present writ petition. 3. Mr. Sankalp Goswami, AC to Mr. A.K. Das, learned counsel for the respondent nos. 4 to 10, submits that if any enquiry has been initiated in the present matter, the same will be concluded without any further delay. 4. Having heard learned counsel for the parties and considering the nature of the prayer made in the writ petition, without commenting on the merit of the case, the respondent no. 8 – the General Manager (Piparwar Area), Central Coalfields Limited, Piparwar, Chatra is directed to verify as to whether any enquiry in the present matter has been initiated, if so, he shall ensure that the same is appropriately concluded.
