ORDER : NAGESH BHEEMAPAKA, J. The case of petitioner is that her husband Late D. Jangaiah while working as a Conductor with Staff No. 208777 in the Telangana State Road Transport Corporation (for short, the Corporation’) in Ibrahimpatnam Depot, Ranga Reddy District, died on 31.10.2022 accidentally falling into a lake situated in their village. He has shown petitioner as his nominee in the Salary Bank Account. It is stated, there is a Memorandum of Understanding (MoU) between TGRTC and respondent bank, according to which it is mandatory that every employee of TGRTC shall open a salary account with the bank and all the existing bank accounts of TGRTC employees shall be converted to Union Super Salary Account which is based on the salary that is being drawn by the employees of the TGRTC and such account holders are eligible for 'free personal accidental insurance amount. 1.1. Petitioner's husband had a Salary Account with respondent Bank and his salary was being credited to his Account No. 138912010001293. After his death, petitioner submitted necessary documents claiming Rs. 40,00,000/- towards free personal accidental insurance amount. Since her claim is not settled, she approached the TGRTC/Bank and obtained copies of certain correspondence and came to know that since her husband's bank account was not converted into Union Super Salary Account and remained as SBGEN account she is not entitled to accidental insurance claim. 2. The 4 th Respondent-Union Bank of India filed its counter stating that the sole ground for not honoring the claim of petitioner for personal accident insurance is that personal accidental insurance scheme is applicable for only account holders of Union Super Salary Account (USSA) and not for General Savings Bank Account (SBGEN) holders. Petitioner's husband's account was under the scheme code SBGEN at the time of death of the customer in October 2022 and converted to USSA2 after the death of customer in December 2023. SBGEN accounts are not covered under accidental insurance claim under bank policy. 3. The Corporation also filed counter admitting the personal accidental insurance policy applied to its employees. It is stated that the Corporation converted its employees' salary accounts to Union Bank from SBI relying upon the offer letter dated 04.10.2021 issued by the Union Bank authorities. It is stated that petitioner's husband who died in an accident occurred on 31.10.2022 was drawing a salary of more than Rs. It is categorically stated that had petitioner's husband been considered under USSA-2 based on his salary, he is eligible for Rs. 40 lakhs as claimed by petitioner towards free personal accident insurance. It is further stated that TGRTC vide letters dated 13.09.2023 and 18.01.2024 requested respondent - Bank authorities to settle the case of late Sri D. Jangaiah (petitioner's husband) under USSA-II category and pay the eligible insurance amount to his legal heirs - petitioner. But respondent Bank is treating him under SB General category and refusing to settle his case under USSA-II category. 4. Heard Sri Saini Aravind, learned counsel for petitioner, learned Standing Counsel for Corporation Sri N. Srushman Reddy, M/s Chavan & Associates Law Firm, learned counsel for Respondent bank and Sri Srinivasa Rao Vutla, learned counsel for Respondent No.5 United India Insurance Company Limited. 5. From a perusal of the material on record and having heard learned counsel on either side, it is to be noted, the Union Bank of India addressed letter dated 04.10.2021 to the Financial Adviser & Chief Accounts Officer, TGSRTC offering a scheme providing 'free personal accident insurance to all PSU employees who have Union Super Salary Account (USSA) in Union Bank of India. The Managing Director, TGSRTC addressed the letter dated 11.10.2021 to all its Unit Officers to inform the employees under their jurisdiction to open Bank Accounts with Union Bank of India. TGSRTC sent letter dated 18.11.2022 to all its Unit Officers inter alia stating: "Since the above provision (personal accidental insurance) is only applicable to employees who have Union Super Salary Account (USSA), Unit Officer shall create awareness among all the employees on above Insurance scheme and advise the Employees/Officers to change their nature of account to Union Super Salary Account (USSA), if they have not opted at the time of opening of account. 6. 6. TGSRTC issued Circular No. PD-07/2021 dated 26.11.2021 ordering that salaries of all Officers and Employees shall be disbursed through Union Bank of India only from the salary bill of December, 2021 payable in January 2022. The Corporation also sensitized all its Unit Officers by letter dated 18.11.2022 about the types of coverage of Free Personal Accident Insurance for PSU Employees viz. USSA-I, USSA-II, USSA-III, enclosing the guidelines etcetera. According to it, employees who are drawing regular salary of Rs. 25,000/- to Rs. 74.999/- will come under USSA-II category. Accordingly, petitioner's husband opened salary account bearing No. 138912010001293 under Account Scheme: SBGEN, on 21.10.2021. His salary is being credited to this account. 7. The Depot Manager, Ibrahimpatnam Depot addressed letter dated 01.12.2022 to the Branch Manager, UBI, Ibrahimpatnam Branch, inter alia stating that free personal accidental insurance provision is only applicable to the employees who have 'Union Super Salary Account' (USSA) in Union Bank of India and requesting to change their nature of accounts to 'Union Super Salary Account' (USSA) if they have not opted at the time of opening of account. The Deputy General Manager & Regional Head, Union Bank of India addressed an inter office letter dated 23.08.2023 to the Chief General manager, Zonal Office, Hyderabad, as below: “ We are in receipt of a letter from our Ibrahimpatnam Branch (13891), regarding consideration of death claim of late Mr. Dumpala Jangaiah bearing account number 138912010001293. Late Mr. Dumapala Jangaiah was a RTC employee and expired on 31.10.2022. he was maintaining salary account with Ibrahimpatnam Branch and salary was crediting from March 2022. As per the MOU between TSRTC and UNION BANK, every RTC employee has to open salary account with our bank and existing account of TSRTC employees has to open salary account with our bank and existing account of TSRTC employees should be converted in to Union Super Salary Account as per the salary received in account. In the account of Late Mr. Dumpala Jangaiah salary was crediting per month approx. Rs. 31,000 from the month of March 2022 and he was existing customer. As per the salary received in account, account should be classified in USSA2, but inadvertently this account was not converted in USSA2 due to some technical glitch. Nominee Mrs. DUMPALLA SHYAMALA (wife of Late Mr. Dumpala Jangaiah salary was crediting per month approx. Rs. 31,000 from the month of March 2022 and he was existing customer. As per the salary received in account, account should be classified in USSA2, but inadvertently this account was not converted in USSA2 due to some technical glitch. Nominee Mrs. DUMPALLA SHYAMALA (wife of Late Mr. Dumpala Jangaiah) has approached the branch for settlement of death claim with Personal Accident Insurance (Death) cover for Central/State Govt., PSU, Police etc. As TSRTC comes under State Govt., and free personal insurance under death by accident is Rs. 40.000 lakhs as per our bank policy. On the basis of the branch recommendation, we request you to kindly consider the branch request for the settlement of death claim of Late Mr. Dumpala Jangaiah to the nominee Mrs. Dumpalla Shyamala." 8. General Manager, Deposit Mobilization Department, Central Officer, Union Bank of India, Mumbai addressed an inter officer letter to Chief General Manager, Zonal Office, Hyderabad, dated 27.09.2023 rejecting the claim inter alia stating: D. Jangaiah (138912010001293): This Account was under the Scheme code SBGEN at the time of death of the customer in October 2022 and converted to USSA2 after the death of the customer in December 2023.SBGEN accounts are not covered under accidental insurance claim under bank policy. 9. From the above, it is clear that the sole ground for rejection of petitioner's claim is that her husband's salary account bearing number 138912010001293 is under the scheme code SBGEN ie. Savings Bank General by the date of death of her husband, hence, she is not entitled to claim free personal accidental insurance. 10. Now, the question that arises for consideration is who is responsible for non-conversion of petitioner's husband's salary account from SBGEN to USSA-II? 11. As stated above, TGSRTC issued Circular No. PD- 07/2021 dated 26.11.2021 ordering that salaries of all Officers and Employees shall be disbursed through Union Bank of India only from the salary bill of December, 2021 payable in January 2022. 11. The Depot Manager, Ibrahimpatnam Depot addressed letter dated 01.12.2022 to the Branch Manager, UBI, Ibrahimpatnam Branch, requesting to change the nature of accounts of its employees to 'Union Super Salary Account' (USSA) if they have not opted at the time of opening of account since the free personal accidental insurance provision is only applicable to the employees who have "Union Super Salary Account (USSA) in Union Bank of India and. Therefore, it is the duty of the Branch Manager, UBI, Ibrahimpatnam Branch, to convert the salary account of the husband of the petitioner from SBGEN mode to USSA-II mode, even if the deceased has not opted for the same. The Branch Manager is solely responsible for non-version of the same. 12. Further, the Deputy General Manager & Regional Head, Union Bank of India addressed an inter office letter dated 23.08.2023 to the Chief General manager, Zonal Office, Hyderabad, stating: As per the MOU between TSRTC and UNION BANK, every RTC employee has to open salary account with our bank and existing account of TSRTC employees has to open salary account with our bank and existing account of TSRTC employees should be converted in to Union Super Salary Account as per the salary received in account. In the account of Late Mr. Dumpala Jangaiah salary was crediting per month approximately Rs. 31,000/- from March 2022 and he was existing customer. As per the salary received in account, account should be classified in USSA2, but inadvertently, this account was not converted in USSA2 due to some technical glitch. From this letter, it is clear that non-conversion of deceased's salary account from SBGEN to USSA-II is the mistake of the Bank advertent or inadvertent, and not of the deceased employee/petitioner or the TGSRTC. Had the Bank acted timely and vigilantly this mistake would not have occurred. It is not just and proper to reject the claim of the petitioner for a mistake done by the Bank. 13. That apart the Depot Manager, TGSRTC, Ibrahimpatnam Depot addressed letter dated 05.01.2023 to the Branch Manager, Union Bank of Inia, Ibrahimpatnam Branch, stating- " This is to submit that, the Union Bank of India was kind enough to inform that they will consider the cases of Officers and Employees who died accidentally during the period from 01.07.2022 to 30.11.2022 for payment of personal accidental insurance under Union Super Salary Account (USSA), though they do not have Union Super Salary Account (USSA) subject to condition that their salaries are credited to the salary account of Union Bank of India continuously for three months i.e., from March 2022 salary bill to May 2022 salary bill. In this regard D. Jangaiah, E. 208777, Conductor of IBPM Depot (A/c No. 138912010001293) has expired accidentally on 31.10.2022. Therefore, it is kindly requested to provide necessary documents to avail free personal accidental insurance to the legal heirs of the above named deceased employee, please." 14. Since the deceased used to draw his salary from the UBI from March 2022 (as seen from inter office letter dated 23.08.2023), even if his salary account was not converted from SBGEN to USSA-II, in view of the above letter dated 05.01.2023 to which the Bank has not replied, petitioner is entitled to get her claim. When all the crucial facts such as the fact that petitioner's husband was an employee (Conductor) of TGSRTC and entitled to the provision of Free Personal Accidental Insurance, he died accidentally on 31.10.2022; by that time, he was drawing his salary from UBI, Ibrahimpatnam Branch; at the time of death, he was drawing about Rs. 31,000/- p.m. salary and is entitled to be categorized as USSA-II etcetera are admitted and undisputed ones, rejection of the claim of the petitioner under Free Personal Accidental Insurance on the sole ground that his salary account was not converted from SBGEN code to USSA-II inadvertently and due to some technical glitch (as admitted by the DGB & Regional Head in his inter office letter dt. 23.08.2023) is illegal and unjust and denting the welfare measures given to the TGSRTC employees. 15. 23.08.2023) is illegal and unjust and denting the welfare measures given to the TGSRTC employees. 15. For the aforementioned reasons the inter office letter, DMD:2608:2023-24, dated 27.09.2023 sent by General Manager, Deposit Mobilization Department, Central Office, Mumbai, addressed to Chief General Manager, Zonal Office, Hyderabad is set aside and consequently, Respondents 4 and 5 are directed to pay jointly and severally petitioner's claim amount of Rs. 40,00,000/- (Rupees Forty Lakhs only) under the provision of Free Personal Accidental Insurance to the Employees and Officers through Union Bank of India. 16. The Writ Petition is allowed accordingly. No costs. 17. Consequently, the miscellaneous Applications, if any shall stand closed.
