ORDER : B Krishna Mohan, J. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. These writ petitions are filed questioning the action of the 2 nd respondent for not getting L.A.O.P. numbered under Section 18 of the Land Acquisition Act in respect of the reference applications of the petitioners referred by the 2 nd respondent vide Ref.A/3/09, Ref.A/20/2009 and Ref.A/14/2006, dated 16.03.2015 to the Senior Civil Judge Court, Poddutur, Kadapa District relating to Award Nos.97/2012- 13, dated 11.01.2013, 37/2012-2013 dated 20.07.2012 and 88/2009-2010 dated 21.07.2009. 3. The learned counsel for the petitioners submits that the 2 nd respondent made reference under Section 18 of the Land Acquisition Act in respect of the claims made by the petitioners for enhancement of compensation and the matters are pending before the Senior Civil Judge Court, Poddutur, Kadapa District in respect of Award Nos.97/2012-13, dated 11.01.2013, 37/2012-2013 dated 20.07.2012 and 88/2009-2010 dated 21.07.2009. 4. On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that even according to the prayer of the writ petitioners already the applications of the petitioners were referred to the competent court under Section 18 of the Land Acquisition Act pursuant to the Award Nos.97/2012-13, dated 11.01.2013, 37/2012-2013 dated 20.07.2012 and 88/2009-2010 dated 21.07.2009 and it is for the petitioners to pursue the remedies before the said court but they cannot seek issuance of Writ of Mandamus against the 2 nd respondent for getting it numbered the L.A.O.P. before the learned Senior Civil Judge Court. 5. In reply, the learned counsel for the petitioners seeks permission to withdraw the writ petitions to pursue the remedies by following the due procedure. 6. In view of the above said facts and circumstances, as the prayer itself is misconceived, the petitioners are permitted to withdraw these writ petitions giving liberty to pursue the remedies available under law following the due procedure in the matter of pursuing Section 18 applications pending before the learned Senior Civil Judge Court, Poddutur, Kadapa District in respect of Award Nos.97/2012-13, dated 11.01.2013, 37/2012-2013 dated 20.07.2012 and 88/2009-2010 dated 21.07.2009. No mandamus can be issued against the judicial body for numbering of the O.Ps. 7. Accordingly, the writ petitions are dismissed as withdrawn. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
